Notice of Sale of Valuable Real Estate, 1916 - Tazewell Co. VA [Clinch Valley News Feb 4, 1916, page 3] By virtue of two decrees entered in the chancery cause of the town of Welch, a municipal corporation, complainant, vs. John W. Waldron, defendant, at the February, 1914, and the August, 1915, terms of the Circuit Court of Tazewell County, Virginia, the undersigned, who was appointed a special commissioner by the first mentioned decree, and as directed in both of said decrees, will, on Monday the 21st day of February, 1916, (being the first day of the February 1916 term of said court) between the hours of 10 a.m. and 2 p.m. of that day, at the front door of the court house of said Tazewell county, Virginia, sell to the highest bidder, at public auction, the following real estate belonging to the defendant, John W. Waldron, of so much thereof as may be necessary to pay off and discharge all of the debts and judgments against said defendant, John W. Waldron, ascertained and adjudged liens on said real estate by the first above mentioned decree, together with the costs accrued in said suit since the first sale there under made on the 30th day of May, 1914, and expenses of this re-sale, as directed and required by said decree entered in said cause at the August, 1915 term of said court, situate in Jeffersonville Magisterial district of Tazewell County, Virginia, consisting of three parcels of land, and more fully described as follows, to-wit: (1) 16.11 acres of land lying on the north side of Stony Ridge in Crockett's Cove, conveyed to J.R> Davidson and wife and J.R. G Brown and wife to John W. Waldron by deed dated March 20th, 1911, and recorded in the Clerk's office of Tazewell county, Virginia in Deed Book 70, page 25, to which reference is here made for a more particular description of said land. (2) A three-fourths undivided interest in and to a tract of about 160 acres of land lying and being on HorsePen Creek and on the base of Big Stony Ridge, which three fourths interest was conveyed to said John W. Waldron by two deeds, one from Margaret Brooks and Sarah Shrader and her husband, dated May 23, 1898 and recorded in said Clerk's office in Deed Book 41, page 318; and the other to said John W. Waldron by A.S. Waldron dated July 6th 1905, and recorded in said office in "Deed Book 57, page 179, the first mentioned deed conveying to said John W. Waldron an undivided one-half interest in said tract of about 160 acres, and the second mentioned deed conveying to him and undivided on-fourth interest in the said tract. This land, about 160 acres was formerly owned by William K. Brooks, and he conveyed same to his wife Matilda Brooks, for life and balance to his four children. Matilda Brooks afterwards conveyed this life estate to John W. Waldron and T.R. Waldron jointly. However, Matilda Brooks is now dead so John W. Waldron owns an undivided three-fourths interest in said tract of about 160 acres above stated. Reference is here made to all of said deeds for a more particular description of said tract. (3) A tract of about 30 acres lying on the north side of Stony Ridge in Crockett's Cove which was conveyed to John W. Waldron by McNeil Brooks and others by deed dated February 28th, 1900, and recorded in said Clerks office in Deed Book 42, page 427, to which deed reference is here made for am ore particular description of said land. Terms of Sale Cash in hand sufficient to pay the additional cost of this suit, accrued since the sale of said lands on the 30th day of May, 1914, and expenses of this sale, and the residue of purchase price upon a credit of one, and two years, the purchaser to execute his two separate bonds with security thereon, approved by the undersigned commissioner, and each of said two bonds is to be for one-half of said residue purchase price, and to be dated and bear interest from date of said sale.
