VA Oct. 29 1836 State of Virginia Tazwell county Know these peresence whom it may concern that I Shorten Smith am about to rain mi body to the Lord and my soul to God. Tat after mi funerl expences is paid..I want all mi reile and pursinal property to be delivered in to the hands of Rebecca Micham as my grand daughter--- agent namly a sertan tract of land of forty fore acres (44). Lying on Tug River also one black mare one cow and one yearling with all mi housel furniture and that do I now make chois of James Milam for her agent and if it plis God I recover mi health this property is to remain min until mi final disclo___ than to remain the the hands of her parents til she coms of age then to be delivered up to her as her lawful right and not to make way or dispose of this property in no way only to use it. I do hereby sign this as mi last will and testament. Browne, DC OB 447 And at another day to wit, in the same court Feb. 11 1837 this writing proposing the last will and testament of shorton Smith Dec’d was again produced for proof by James Milam whereupon a motion of Eli Blankenship and Isaiah Smith by there attorney it is ordered that said will be contested on the first day of the next term. And at another day to wit; in the same court on the 5th day of March 1837 this writing suporting the last will and testement of Shorton Smith Dec’d was again produced in court by James Milem and by concent of parties the said writing was further proven by the oath of Henry Milem a subscriber testify thereto and ordered to be recorded.
