Will of Francis Tabor Tazewell County, Virginia Will Book # 4; PAGES 787-788 In the name of God amen I Francis Tabor of the county of Tazewell and State of Virginia being weak of body but of sound mind and disposing memory knowing the uncertainy of life and being desirous of disposing of such estate as God hath been pleased to give to me do make and constitute this my last will and testament and hereby revoke all others made by me. Desiring that my property shall be disposed of in manner and form as follows: First I desire that my executor hereinafter named shall so soon after my death as convenient sell all my personal property and collect all debts that may be due to me and pay my funeral expenses and all debts that I ear justly owe. Secondly I desire that my real estate shall be disposed of in the following manner: For as much as Adam E. Waggoner my son in law has purchased the interest of my daughter Mary MARRS in my real estate and James C. Dudley, my son in law, HAVING PURCHASED THE INTEREST Of EMERINE V. MARRS IN THE said real estate, I will and bequeath that the real estate now owned by me be divided between Julina E. Waggoner and Mariah L. Dudly in the following manner: Commencing at a point in the northwestern boundry line Macedonia church and running on a degree parallel with the general course of the lines of the southwest end of the tract so as to divide the land equally according to quantity acre for acre. I will and bequeath that the said Mariah L. Dudley shall have the east end of the said real estate and the said Julina E. Waggoner is to have the west end; the said Mariah L. Dudly is to pay to the said Julina E. Waggoner within twelve months one hundred dollars as a difference in the land. For as much as I have heretofore advanced to my son William J. Tabor land and property I will and bequeath that he relieve fifty dollars more to be paid out of my personal effects as his full share of my estate. I will and bequeath that after payment of funeral expenses, charges of administration, debts, commissions, and the above named legacy of fifty dollars to William J. Tabor, the rest and residue of my estate be divided equally among my following named children or their heirs: Mary A. MARRS, EMERINE V. MARRS, Julina E. Waggoner Mariah L. Dudly. I hereby constitute and appoint Hugh D.
