Joseph Scott, Sen, Revolutional War pension record. Washington Co. VA ----------------------------------------------------------- State of Virginia At a court continued and held for Washington County this 27th day of May 1853 Ordered that it has certified that it appears to this court by legal and satisfactory evidence that Joseph Scott, Sen. deceased was a revolutionary soldier of the United States; that he departed this life in this county on the 15th day of October 1833 leaving a widow whose name was Mary. That the said Mary Scott the widow of the said Joseph departed this life in this county on the 10th day of May 1840, and that the said Joseph and Mary were married in the year 1783. And it is further ordered to be certified that the said Joseph and Mary Scott left twelve children whose names are George, William, Elias, Obadiah, Alexander, Thomas and Joseph Scott, Sally who intermarried with Thomas Cawood, and who is now dead; and left no child. Eliza Scott who was the wife of James C. Dunn, Harriet Allsup the wife of Joseph Allsup, Lucretia who intermarried with William Allison and who is now dead, leaving children whose names are unknown and Julia Ann the wife of William Talbert. And that the said William, Elias, Obadiah, Alexander, Thomas and Joseph Scott, Elizabeth Dunn, Harriet Allsup and Julia Ann Talbert and the said children of the said Lucretia Allison deceased are the legal heirs of the said Joseph Scott Sen. deceased and of the said Mary Scott both deceased. I Jacob Lynch Clerk of the court of the said county of Washington do hereby certify that the above is a true copy from the records of the court of the said county of Washington and I do further certify that John N. Humes whose genuine signature to the foregoing declaration of Obadiah Scott and to the certificates annexed to the foregoing Power of Attorney now is and was at the time of signing the same an acting justice of the peace in and for said county, duly elected commissioned and qualified and is in full faith and credit as due all such acts as such and that the aforesaid county court is a court of record having general jurisdiction. State of Virginia, county of Washington Be it known that on this day personally appeared before me a Justice of the peace for the County aforesaid, Obediah Scott, for himself and the heirs of Joseph Scott and made oath in due form of Same that his Father, Joseph Scott, Enlisted into the Continental Army of the United States in the War of the Revolution, that he did so Enlist in the State of Virginia under Capt George Jesup (or ...) that he the said Joseph Scott Served in the Continental army for the term of three years, under Genl George Washington to the end of the War and that proof of said Service is Manifest on the Rolls in the Department and to Sustain this declaration, the Evidence of the said Joseph Scott proved the service of John McCauly, a pensioner of the United States in the County of Washington, and at that day the Service of the Said Joseph Scott was proven by the said John McCauly. Which by neglect of the Said Joseph Scott was never forwarded to the pension office. And at this time cannot be found, the Said Joseph Scott resided in the County of Washington and departed this life, in Said County on the 15th day of October 1833, that his widow Mary Scott, survived the Said Joseph Scott her Husband untill the 10th day of May 1840, that the said Joseph and Mary Scott were married in the year 1783 and by Act of Congress the Said Joseph, if living on the 7th day June 1832 Would be Entitled to pension from the 4th of March 1831 up to the time of his death, 15 day of October 1833. Making two years, seven months, and Eleven days full pension Would be $251 Dollars. And if his Widow was married to him Subsequent to Service, Which was in 1783. She would be Entitled to the Same Amount of pension from the 4th day of March 1836, during her natural life. Which terminated in the County of Washington, on the 10th day of May 1840, Which would entitle her to pension for Four years, two Months, and Six days; at full pension Would be $402 Dollars Added to the Amt due the Said Joseph Scott will make the Sum of $653 Dollars, the Heirs are Legally Entitled to, Which said Heirs are the Children, and personal Representatives of the said Joseph Scott (to Wit) William Scott, Elias Scott, Alexander Scott, Thomas Scott, and Obediah Scott, who makes this claim herein for the Joint benefit of the above Mentioned Heirs, and by act of Congress. Where pension is due and not claimed by the Soldier or his Widow, under the provision of the aforesaid Acts of Congress as to dates and specifications, It is competant for the Heirs to claim and obtain the amount of pension due the parties, the said Heirs of Joseph Scott, Now respectfully ask that said amt of pension due to Joseph Scott and to his widow Mary Scott be paid the Said Heirs, Who are the Children of the Said Joseph and Mary Scott. Humes JP State of Virginia } SS County of Washington } Know all men by these presents, I Obadiah Scott of the County of Washington and State of Virginia do hereby constitute and appoint John W. Stevens My true and Lawful Attorney for me and in the Names of the Heirs of Joseph Scott, and In our Names to demand and claim for the agent of the United states for paying pension in the City of Richmond and State of Virginia the amount of pension due to the said Joseph Scott, from the 4th day of May 1840 that being the day of his death, that all acts of our said attorney touching the pension, shall be binding on us Jointly and Severally, to all Intents and purposes of the Same, Witness my hand and seal this 16th day of May 1853. Stevens, the attorney named in the foregoing power of Attorney, and made oath that the Same was not given him by means of any Sale transfer or Mortgage of the pension, or arears of pension, therein authorised to be Received by him. Sworn and Subscribed the day and year last above Mentioned before me J. M. Humes J.P. In the absence of living proof, that the said Joseph Scott was a Revolutionary Soldier, the Heirs of said Scott asks that be had to the papers as Evidence in the Case of John McCauly who now is pensioned, in which papers in the clerks office, it will be seen that the service of the said John McCauly was proven by said Joseph Scott who served with the said McCauly in the Revolutionary War. Ordered that it be certified that it appears to this court by legal and satisfactory eveidence, to wit, by the evidence of James McNew, John D. Mistchell and Samuel Logan, who were duly sworn in court, that Joseph Scott Sen. departed this life in this county many years ago, that he left a widow whose name was Mary, who also departed this life. And that the said Joseph Scott Sen. and Mary his wife left twelve children, whose names are George, William, Elias, Obadiah, Alexander, Thomas and Joseph Scott, Sally who intermarried with Thomas Cawood and is now dead and left no child, Elizabeth who is now the wife of Charles C. Dunn, Harriet Allsup the wife of Joseph Allsup. Lucinda who intermarried with Robert Allison and is now dead, leaving children whose names are unknown. And Julia Ann who intermarried with William Talbert. That the said George Scott is now dead and that he left no child or children. And it is further ordered to be certified that the said James McNew, John D. Mitchell and Samuel Logan are residents of this county and of the neighborhood where the said Joseph Scott Senr and Mary Scott his wife and widow lived; that they are reputable persons and are entitled to credit. And that it appears to the satisfaction of the court from the evidence aforesaid, that William, Elias, Obadiah, Alexander, Thomas & Joseph Scott, Charles C. Dunn & Elizabeth his wife, Joseph Allsup and Harriet his wife, William Talbert and Julia Ann his wife and the children of Lucretia Allison deceased are the legal heirs and representatives of the said Joseph Scott Senr and of the said Mary Scott deceased. The foregoing is a true copy from the records of the court of the said county of Washington.
