RISTEN/ARBOUGH INDENTURE - WASHINGTON COUNTY, VIRGINIA Submitted by: "Lonnie M. Arbaugh" This Indenture made the eighth day of November one thousand eight hundred between Elisha Risten and Ann his wife of Washington County in the State of Virginia of the one part and Francis Arbough of the County and State aforesaid of the other part. Witnesseth that Elisha Rosten and Ann his wife for and in consideration of the sum of one hundred and ten pounds lawful money of Virginia to them in hand paid there receipt whereof they hereby acknowledge have bargained and sold and by these presents do bargain and sell unto Francis Arbough one parcel or tract of land containing one hundred acres by survey bearing date the fourteenth day of November on thousand seven hundred and eighty two, lying and being in the County aforesaid in the poor valley and bounded as followeth to wit Beginning at a spruce pine on turkey gap creek corner to Cornelius Dovees's survey and with his line running thence North seventy degrees west thirty two poles to a white oak in the a bent of the creek thence North thirty two degrees west thirty poles to a double poplar at the foot of a ridge North sixty five degrees west sixty four poles to two Buckeyes and three ?lynns by the side of the creek North sixty two degrees west one hundred and twenty poles to a spanish oak by the side of the creek North fifty degrees East sixty two poles to a white oak gum and dogwood South sixty nine degrees East sixty poles to a three dogwoods South eighty degrees East one hundred and eighty eight poles to the foot of piney mountain thence South thirty six degrees west one hundred and thirty poles to the Beginning. Which said parcel or tract of land with its appurtenances the aforesaid Elisha Risten and Ann his wife do for themselves and their heirs warrant and defend unto the aforesaid Franics Arbough and his heirs forever against the claims of all manner of person whatsoever. In witness whereof they have hereunto set their hands and affixed their seals the day and year first above written. Signed sealed and Elisha (his X mark) Risten acknowledged in presence of Ann (her X mark) Risten William Poston William Crabtree Daniel (his X mark) Grace At a Court held for Washington County the 17th day of March 1801 This Indenture of bargain and sale was proved in Court by the oaths of Will Porton and Daniel Grace, Two of the Witnesses thereto. And at a court held for the said County the 15th day of October 1805. It was further proven in Court by the oath of William Crabtree a witness thereto & ordered to be recorded. Attest D. This Indenture made this tenth day of Oct. one thousand eight & five Between Francis Arbough & Mary his wife of the County of Washington of the one part and John Cypher of said county of the other part, Witnesseth, that the said Francis Arbough for and in consideration of the sum of one hundred dollars current money to (him) them in hand paid by the said John Cypher, doth bargain & sell unto the said John Cypher & his heirs one certain tract or parcel of land containing one hundred acres by survey bearing date the fourteenth day of November one thousand seven hundred and eighty two lying and being in the County of Washington in the poor valley & bounded as followeth to wit Beginning at a spruce pine on Turkey gap creek, corner to Cornelius Duveese survey & with his line running thence N 70 W 32 poles to a white oak in the bent of the creek, thence N 32 W 30 poles to a double poplar on the side of a ridge N 65 2 64 poles to two buckeyes & three lenns by the side of the creek N 62 W 120 poles to a spanish oak by the side of the creek N 55 E 62 poles to a whiteoak gum and dogwood S 69 E 60 poles to three dogwoods S 80 E 188 poles to the foot of piney mountain thence S 36 W 130 poles to the Beginning, with all its appurtenances. To have and To hold the said tract or parcel of land containing one hundred acres with all its appurtenances unto the said John Cypher & his heirs to the sole use & behoof of him the said John Cypher & his heirs forever. And the said Fancis Arbough for himself & his heirs doth covenant with the said John Cypher & his heirs that he the said Francis Arbough & his heirs the said tract or parcel of land containing one hundred acres with all its appurtenances unto the said John Cyphjer & his heirs against the claims of all persons whosoever shall warrant and forever defend. In witness whereof the said Francis Arbough and May his wife have hereunto subscribed their names and affixed heir seals the day & year first above written. sealed & delivered in presence of Francis Arbough SS William Tate, Basil Roberts, Mary Arbough SS James Crabtree For Francis Arbough William Campbell At a Court held for Washington County the 20th day of May 1806. This Indenture of bargain & sale was proven in court by the oath of Basil Roberts and James Crabtree two of the witnesses thereto. It was also proved in the Clerks Office of Washington County on this 1st day of June 1819 before Jacob Lynch deputy Clerk of the said county by the oath of William Campbell another witness thereto and ordered to be recorded.
