Burson/McNew Deed - Washington County, VA Deed Book #32 Page 469 Whereas I am justly indebted to Mary McNew in the sum of two hundred and ten dollars with interest thereon at the rate of 6 per cent per annum from the 1st day of September 1876 until paid due by note dated the day and date last aforesaid and payable twelve months after date thereof which debt I am desirous to secure to the said Mary McNew, now in consideration of the promise and in the further consideration of one dollar to me in hand paid by John E. Burson at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, I do hereby give, grant, bargain and sell unto the said John E. Burson and his assigns forever all and singular the goods and chattels following that is to say, one yellow mare, nine years old and nearly fifteen hands high, one yellow mare two years old past about fifteen hands high, one black horse two years old past about fifteen and one half hands high, one two horse wagon and a double set of harness and two milch cows and all the household and kitchen plunder which I have, consisting of four bedsteads and bedding including quilts, blankets, sheets, ticks, straw and feather pillows and cases. One bureau, one half dozen chairs, one folding leaf table, knives and forks, plates and tableware, one safe and one small table, pots, cooking utensils, kitchen table etc, One clock and two watches, one silver and one brass. And I do for myself and my heirs covenant with the said John E. Burson and his assigns that I will forever warrant and defend the title to the said property to the said John E. Burson and his assigns free from the claims of all persons whatsoever. Upon trust never the less that the said John E. Burson and his assigns shall permit me to remain in quiet and peaceful possession and enjoyment of the said property provided I keep it in the town of Bristol- Goodson, and take the hire and profits thereof to my own use until default be made in the payment of the said debt and interest on any part thereof, and then upon this further trust that so soon after the happening of such default of payment as the said John E. Burson or his assigns or as I myself shall request the said is authorized to take possession of the said property and will proceed to sell the same or so much thereof as shall be required for the purpose at public outcry to the highest bidder for cash having first fixed the time and place of sale at his own discretion and given notice thereof for ten days by notice posted at three public places in the town of Bristol-Goodson, Va. and Tennessee. In the event of death, removal or refusal of the said John E. Burson to act in case of default of payment then the Town Sergeant of the Corporation of Bristol or Goodson shall have the power and duties of the said John E. Burson conferred upon him and is hereby authorized to do in respect to said property anything that might under this said trust by the said John E. Burson. Out of the proceed of said sale the said John E. Burson shall first pay the expenses of this trust and all other expenses that may attend the execution of the same, and shall next pay to the said Mary McNew her debt aforesaid with interest aforesaid and the remainder if any shall pay to me or my assigns. In default by any means of the said John E. Burson to act his powers are conferred on either of the Town Sergeant aforesaid of the Corporations aforesaid.
