Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ***************************************************************** This Indenture made the fifteenth day of October in the year of our Lord one thousand eight hundred and eight between Jacob Goodman of Washington county in the Commonwealth of Virginia and William Sitzer of Sullivan County and state of Tennessee and Catharine his wife the said Jacob Goodman and Catherine Sitzer being children and coheirs of Jacob Goodman late of Washington county aforesaid Deceased who died intestate of the one part and George Goodman of said Washington county another son and heir of said Deceased of the other part. Whereas the said Jacob Goodman deceased in his life time was seized in his demesne as of fee of in and to two certain contiguous tracts pieces or parcels of land situate lying and being in the county of Washington aforesaid on the head waters of Beaver Creek a branch of Holston River and the one of them bounded and described as followeth to wit. Begining at four white oak saplings in a hollow at the east end of a brushy ridge and running thence North nine degrees West one hundred and fifty four poles crossing Fulkerson's spring branch to a triple white oak by the same North thirty seven degrees West one hundred poles to a hickory sapling and two white oaks West eighty five poles to three small white oaks at the foot of a naked hill South twenty seven degrees West 100 poles to a hickory sapling and two white oaks West 85 poles to three small white oaks & the foot of a naked hill West sixty eight poles to three red oaks on the end of a ridge, South fifty degrees West one hundred and eighty seven poles to two white oaks corner to James Fulkerson's land and at the foot of the brushy ridge thence South eighty four degrees East three hundred and forty four poles along said ridge to the Beginning. Containing three hundred acres (It being the tract granted to said Jacob Goodman as assignee of Abraham Fulkerson who was a assignee of Edward Callaham by patent bearing date the first day of September in the year of our Lord 1785) the other of them Beginning at three small white oaks a corner to the above described tract of land and running thence South seventy eight degrees West one hundred and two poles to a white oak and black oak in a hollow South forty eight degrees West eighty poles to three white oaks on the bank of a sink hole South six degrees West one hundred and eight poles to two white oaks a corner of the above described tract of land and with the lines thereof North fifty degrees East one hundred and eighty seven poles to three red oaks at the end of a ridge North twenty one degrees East sixty eight poles to the Beginning. Containing eighty four acres (It being the tract granted to the said Jacob Goodman by patent bearing date the fouteenth day of September on the year of our Lord 1792. Now this Indenture Witnesseth that the said Jacob Goodman and William Sitzer and Catharine his wife for and in consideration of the sum of eighty dollars in specie to them well and truly in hand paid by the above said George Goodman at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged, have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant, bargain, sell alien enfeoff release and confirm unto the said George Goodman and to his heirs and assigns all their the said Jacob Goodman's and William Sitzer's (in right of his wife Catharine) parts shares dividends or portions of in to or out of the above two described contiguous tracts pieces or parcels of land together with their or either of their respective appurtenances. To have and to hold their the said Jacob Goodman's and William Sitzer's (in right of his wife Catharine) parts shares dividends or portions to the said above described tracts pieces or parcels of land with the appurtenances unto the said George Goodman his heirs and assigns To the only propper use and behoof of him the said George Goodman his heirs and assigns forever. And they the said Jacob Goodman and William Sitzer and Catharine his wife do covenant promise and grant to and with the said George Goodman his heirs and assigns by these presents that they the said Jacob Goodman and William Sitzer and Catharine his wife and their heirs respectively to the above described two contiguous tracts, pieces, or parcels of land their parts, shares, dividends or portions therein, together with the appurtenances, against them the said Jacob Goodman and William Sitzer and Catharine his wife and their heirs respectively and against all and every other person or persons whosoever lawfully claiming or to claim by from pr under them or any of them shall & will warrant and forever defend by these presents. In Witness whereof they the said Jacob Goodman and William Sitzer and Catharine his wife have hereunto set their hands and seals. Dated the day and year first above written. Sealed and Delivered Jacob (his X mark) Goodman Seal in the presence of Seal Adam Flener Seal Martin Gowing Benjn Spyker At a Court held for Washington county the 20th day of December 1808. This Indenture of bargain and sale was proven in court by the oaths of Adam Fleener and Martin Gowing two of the witnesses thereto as to the execution thereof by Jacob Goodman and at a court held for the said county the 23rd day of February 1809 It was further proven by Benjamin Spyker a witnesses thereto & ordered to be recorded.
