I desire that my body be discently buried as touching such wordly goods as it has pleased God to bless me with I dispose of them as follows. First- I desire the payments of all my past debts and funeral expenses, so soon after my death as can be conveniently done by my executors- Second- Having married Nancy Hughes (large space blotted out ) whom (large space blotted out ) son known and call by the name of Landon(large space blotted out ) I hearby desired to acknowlede and (large space blotted out ) him and I do by this my last will further acknowledge and (large space blotted out ) him I do by unto the said Landon(large space blotted out ) all my land and personal property of every discription and kind what ever subjects to the legal dower of his mother Nancy now my wife-Rrequiring him to comply with a contract I have made with him relations to an illegitamate child of mine called Joseph M Kinney who resides when last heard from in the state of Indiana the said Joseph being the son of Catherine M Kinney who was a daugher of Colin McKinney late of Washington County Virginia and also exceptions from this devise the legacy hereinafter mentioned to Catherine Bryan my niece. Third- It is my will that my will that my executors do sell my personalty so soon after my death as conveneint on a credit of twelve and eighteen months. Fourth- I give to my niece Catherine Bryan to be paid by my executors thirty dollars as some compensaton for ? (her) kinship to me during various periods of my sickness and confinement. Lastly I do hearby appoint Harold Smyth and Jacob Synch my executors allowing them a compensation of five percent on the sales and amount of my personal estate for their trouble in executing the same and that same on all disbursement- I do hereby revoke all former wills by me made- Given under my hand I seal this 12th day of May 1843. sighned sealed acknwoledged by James Bryan as and for his last Will and Testament on our presence his and we have witnesfed the same James X Bryan in presence of each others and at his mark request. T K Catlett Joseph Haskew George R Winniford At a court Continues and held for Washington County 31 day of August 1843 The last Will and Testament of James Bryan deseased was proved in court by the oathe of Joseph Haskew and George R G Winniford two of the subscribed witnesses thereto and ordered to be recorded- And at a court held for Washington County the 23 day of October 1843 Harold Smyth and Jacob Linch the executors named in the last Will and Testament of James Bryan deseased appeared in court and refused the executorship- And on the motions Martin Hagy who took the oath of an administrator with the will annexed prescribed by law entered into and acknowledged by his bond in the sum of Eight hundred dollars with David Clark as his security conditions as the law directs- A Certificate is therefore granted ?
