WILL OF JAMES CRABTREE Will Book 5, p. 113, Washington County, Virginia 11 February 1823 In the name of God Amen - I James Crabtree of Washington County and State of Virginia, being of sound & disposing mind & memory but weak in body, and calling to mind the uncertainty of life and being desirous to dispose of such worldly estate as it hath pleased God to bless me with, which has not been disposed of by my Deed of Gift which bears the same date with this my last Will and Testament. Do make & ordain this my last Will and Testament in manner following that is to say - I desire that the whole of my estate which has not been disposed of by my deed of Gift this day executed by me, after paying all my just debts, may be equally divided between my son Gabriel Crabtree and my Grandson James Crabtree the son of Sally Buchanan, to take effect or to be done immediately after my decease. It is my Will & desire that my negro man Stephen shall enjoy his freedom during his natural life. - The above mentioned property of whatever kind it may happen to be at my decease, is to be enjoyed by my son Gabriel Crabtree & my Grandson James Crabtree their heirs and assigns forever. And lastly I do constitute and appoint my friends Richard Roberts, Jun. & James Taylor Executors of this my last Will & Testament, hereby revoking all other & former Wills and Testaments by me heretofore made. In Testimony whereof I have hereunto set my hand & affixed my seal this 11th day of February 1823. Crabtree & Alexander (his mark) Buchanan At a court held for Washington County the 15th day of July 1823. The last Will & Testament of James Crabtree, dec'd was exhibited in court and proven by the oath of Samuel Taylor James F Crabtree and Alexander Buchanan the subscribing witnesses thereto and ordered to be recorded - and the executors named in the said Will refuses to take probate thereof. On the motion of Gabriel Crabtree one of the sons of the testator, there being no widow living, who took oath of an administrator, with the will annexed, prescribed by law and entered into and acknowledged his bond with James Taylor, security in the sum of five hundred dollars conditioned as the law directs - A certificate is therefore granted him for the administration of the estate of the said James Crabtree, dec'd, with the will annexed in due form. Crabtree and Priscilla Richardson As well as the further consideration of one dollar to me in hand paid by each of the above named persons have given and granted and by these presents do give grant and confirm unto the said James Crabtree, John Crabtree Riece Crabtree Thomas Crabtree sons of Priscilla Richardson and my grandson James Crabtree the son of Sally Buchanan and Polly Johnston the wife of Benjamin Johnston and James Crabtree John Crabtree Eliza Crabtree Maria Crabtree Solomon Crabtree Gabriel Crabtree Sally Crabtree and Charles Crabtree children of James F. Crabtree and Priscilla Richardson their executors administrations and assigns To James Crabtree the son of Priscilla Richardson I give the whole of the tract of land whereon the said Priscilla Richardson now lives from a line which is to be run across the survey at the head of the meadow or near that place to the upper end of the tract to be enjoyed by him his heirs and assigns forever. From the above mentioned line at the head of the meadow to the lower end of the tract I give to my grandson James Crabtree the son of Sally Buchanan from the time of my death till he comes of full age he is to receive all the profits and advantages of the said tract of land and to be enjoyed by him, his heirs and assigns forever To Thomas Crabtree the son of Priscilla Richardson I give the whole of the tract of land which I purchased of John Lammie and which is now in the possession of the said Thomas Crabtree the son of Priscilla Richardson I give one third of the Plaster Bank which I purchased of Robert Buchanan to be held and enjoyed by him, his heirs and assigns forever. To John Crabtree the son of Priscilla Richardson I give my negro woman Fenley to be held by him with her increase to himself and his heirs and assigns forever To James Crabtree the son of Priscilla Richardson I give my negro man named Stephen, but it is to be distinctly understood that it is only during my live as it is my intention that the said negro Stephen is to be free at my death. To Priscilla Richardson I give my negro boy named John to be enjoyed by her, her heirs and assigns forever. To James Crabtree the son of Priscilla Richardson I give my Smiths tools and machinery thereto belonging to be enjoyed by him, his heirs and assigns forever. To Priscilla Richardson I give my bed and furniture and bed stead and two cows to be enjoyed by her, her heirs and assigns forever. To Polly Johnston wife of Benjamin Johnston, James Crabtree, John Crabtree, Eliza Crabtree, Maria Crabtree, Solomon Crabtree, Gabriel Crabtree, Sally Crabtree and Charles Crabtree, children of James F. Crabtree I give four feather beads(sic) and furniture one horse two cows four bed steads, one loom, two ploughs, two pots and two ovens a quantity of pewter three sows and twelve pigs one pair of fire irons, eight geese, to be enjoyed by their heirs and assigns in equal proportions according to the value of said property. To have and to hold the said above mentioned property unto them the said James Crabtree, John Crabtree, Riece Crabtree and Thomas Crabtree sons of Priscilla Richardson and James Crabtree son of Sally Richardson [should be Buchanan], Polly Johnston wife of Benjamin Johnson, and James Crabtree, John Crabtree, Eliza Crabtree, Maria Crabtree, Solomon Crabtree and Gabriel Crabtree, Sally Crabtree & Charles Crabtree, the children of James F. Crabtree, and Priscilla Richardson their heirs, executors, administration and assigns forever. And the said James Crabtree for myself, my heirs, executors and administrations the said property unto the said above named persons their executors, administrators and assigns against the claim of me the said James Crabtree my heirs executors and administrators and of every other persons whomsoever shall and will warrant and forever defend. Crabtree & Alexander (his mark) Buchanan At a court held for Washington County the 15th day of April 1823 This deed of gift from James Crabtree, Senr. to James, John, Riece & Thomas Crabtree sons of Priscilla Richardson James Crabtree son of Sally Buchanan Polly Johnson wife of Benjamin Johnston, James, John, Eliza, Maria, Solomon, Gabriel, Sally and Charles Crabtree children of James F. Crabtree and Priscilla Richardson was proved in Court by the oath of James Taylor a witness thereto to be the act and deed of said James Crabtree, Senr. And at a Court continued and held for said county the 16th day of April 1823. It was further proved in Court by the oath of James F. Crabtree another witness thereto to be the act and deed of said James Senr. and at a court held for the said county the 15th day of July 1823. It was further proved by the oath of Alexander Buchanan a witness thereto and ordered to be recorded. Teste, Jacob Lynch
