Davis, of the county of Washington and State of Virginia, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last will and testament; that is to say: First, after all my lawful debts are paid and discharged, the residual of my estate, real and personal, I give, bequeath and dispose of as follows. To Alice L. Davis and Laura A. Davis heirs of my son William M. Davis deceased: Fifty acres of my lands known as the Jamerson tract, with all its appurtenances attached thereon, said tract was conveyed from Thomas Jamerson to William Davis and bounded as follows: beginning at a forked dogwood in the field and corners to the land of William Davis deceased, thence S 15 degrees E 9 poles to a white oak, thence 42 1/2 E 60 poles to two chestnuts, thence S 20E 24 poles to two chestnut oaks on the top of a knob, thence S 55 degrees E 29poles to a black oak, thence S 15 degrees E 9 poles to a hickory, thence N 43 degrees E 24 poles to two spanish oaks and a gum, thenceN 57 degrees E 56 poles to a beech and poplar, thence N 39 degrees W 72 poles to a white oak on William Davis deceased line and with it S 89 degrees W 98 poles to the Beginning. Also six acres adjoining the same, bounded as follows: beginning at the dogwood and running North with the line fence of Wm I. Hayton and myself to the Valley road, thence to the line of T.J. Hayton, thence South with the road running to Jamerson Haytons to the above mentioned fifty acres and thence with it to the beginning at the dogwood. The said lands are not to be sold during the time that either of the above mentioned Alice L. Davis and Laura A. Davis are minors. To my daughter Mary Jane Hagy that part of my lands known as the Etinson tract and bounded as follows: beginning at two sourwoods and a white oak sapling in a line of John Potts, thence running N 68 E 151 poles to two chestnuts on the East side of a branch corner to Andrew Russell and Goodmans land and with Goodman's line N 70 degrees E 14 poles to a small white ash on the west side of a branch, thence N 33 W 24 poles running down the branch to a beech corner of said Goodman's land thence S 84 W 64 poles to between pointers to two black oaks a chestnut and dogwood on the top of a ridge corner of Goodman's land, thence N 24 W 16 poles to a chestnut oak on the top of the same ridge corner to Thomas Jamerson and Goodman and with Jamerson's line, S 35 degrees W 34 poles to a large chestnut oak on a narrow ridge, near a path thence S 82W 18 poles to two chestnut oak saplings, S 68 W 20 poles to a small sourwood on the top of a ridge still with Jamerson's line S 34 W 22 poles to a rock in the line of John Potts land and with the same S 30 E 40 poles to the beginning. Also a part of a field of the Home place as follows: beginning a white oak near the barn and running to the branch, thence with the fence around the field to the white oak, which is known as the barn field, during the tern of her natural life, and after her death to be divided equally between her children if she should have any living, and if she should have no children living at the time of her death, it is to be divided equally between my surviving heirs. To my daughter Emaline F. Davis six acres as follows: all my land on the south side of the Valley road, also my interest in the lands known as the Mary Ann Davis Dower, also one hundred dollars in money to be paid by my son James F. Davis out of his own private means as specified below. To my son James F. Davis the remainder of the home place with all its appurtanances situated thereon after him paying my daughter Emaline F. Davis one hundred dollars in money or cattle at the market price. I give, bequeath and devise all my personal estate to that one of my heirs, who may be living with me at the time of my death. I make, constitute and appoint my son James F. Davis to be executor of this my last will and testament, hereby revoking all former wills by me made. In witness whereof, I have hereunto subscribed my name and affixed my seal, this the 21st day of April in the year of our Lord one thousand eight hundred and seventy four. Thomas J. Davis in our presence, and acknowledged by him to each of us; and at the same time published and declared the above instrument so subscribed to be his last will and testament, and we at the testator's request and in his presence have signed our names as witnesses. J.N. Mallicote Thomas J. Hayton At a court begun and held for Washington County the 27th day of December, 1880. The last Will and Testament of Thomas J. Davis dec'd was produced in court and proved by the oath of Thomas J. Hayton, one of the subscribing witnesses thereto and the signature of J.N. Mallicote, the other subscribing witness, was proven by the oath of Thomas J. Hayton and ___________ and the said will ordered to be recorded. And on motion of James F. Davis, the Executor prescribed by law and together with David C. Hagy and Thomas J. Hayton his securities entered into and acknowledged a bond in the sum of Two hundred dollars, conditioned as the law directs. A certificate is therefore granted him for the probate of said will in due form. Teste. Wm G.
