Last Will and Testament of Nathaniel MAXWELL, Washington Co, VA - July 11, 1828

In the name of God, Amen.  
   I, Nathaniel Maxwell of the county of Washington, and state of Virginia, being aged and 
infirm in body but of sound mind and disposing memory for which I thank God: and calling 
to mind the uncertainty of human life, and being desirous to dispoze of all such worldly 
estate as it hath pleased God to bless me with, I do hereby make this my last Will and 
testament in manner and form following: that is to say, after all my just debts and funeral 
expenses are paid - I leave and bequeath to my loving wife Esther Maxwell all my 
household and kitchen furniture for her own use and to be at her disposal and she is to 
have full and free use of the house we now live in, the spring and garden during her 
natural life: also to have two cows and four sheep.  I hereby bind my son Nathaniel 
Maxwell to furnish my wife with a sufficiency of meat and bread and to feed and take care 
of her above named stock; to furnish her a sufficiency of firewood, cut at her door, and to 
give her one fourth acre of flax anuly delivered at her house.  The above described 
demand  are to be binding on the said Nathaniel during the natural life of my wife and no 
longer - I leave and bequeath to my son Nathaniel Maxwell all the balance of my land not 
heretofore disposed of it being two tracts one containing one hundred and fifty acres here 
I now live and the other seventy four acres and adjoining the above be the same more or 
less, subject to the above claim of his mother during her natural life.  I also allow my 
grandson Nelson at my death to take away his property which consists of one horse 
some cows and hogs free from any charge.  I leave and bequeath to my son William 
Maxwell all the balance of my estate of whatsoever kind it may be whether real or 
personal, not heretofore disposed of and also all the stock that my wife may die 
possessed of is to pass to the aforesaid William.  And lastly I do hereby constitute and 
appoint my two sons William Maxwell and John Maxwell executors of this my last will and 
testament, hereby revoking all other or former wills or testaments by me heretofore 
made.  In Witness whereof, I have hereunto set my hand and affixed my seal this 11th 
day of July in the year 1828."

At a Court held for Washington County the 27th day of January 1834
     The last Will and Testament of Nathaniel Maxwell deceased was exhibited in court 
and proved to by the oath of Edward Lathim and James E Lathim two of the subscribing 
witnesses thereto and ordered to be recorded.  And on the motion of John Maxwell one 
of the executors therein named who took the oath of an executor prescribed by the law 
and entered into and acknowledged his bond in the sum of three hundred dollars with 
Jonathan King his security conditioned as the law directs.  A Certificate is therefore 
granted him for the probate of the said Will in due form.
