I William McMillan of Washington Countv in the State of Virginia am aged but of perfect mind and disposing memory. Unto my beloved wife Mary the whole of the income of arent-charge, or yearly annuity granted unto me & her by my son in law Robert Davis by Indenture bearing date 15 March A.D. 1808 to hold unto her during her natural life. Unto my loving son Francis McMillan, my plantation containing 433 acres the same tract of land granted unto me by John Davis and wife by Indenture bearing date 14 Mar 1808 ... (Gives power of attorney to Executors to sell) after my decease a certain tract of land I hold by patent situate in Washington County ... containing 100 acres more or less adjoining lands of Abraham Hartenstein John Gibson & the land I made over to my son in Law Robert Davis, ...(Executors also to sell) my man slave George and the boy slave Cyrus either by public auction or private sale ... for the best price that can be gotten therefor but my woman slave Rachel shall be retained through the natural life of my beloved wife Mary to wait upon her in her present helpless condition but should said Slave Rachel be undutiful and misbehaving executors to sell her and provide another nurse for Mary. Money arising from the sale of said land and slaves and the other personal estates also debts due me after my just debts if I have any and my funeral expenses shall be paid I order to be distributed & divided in the following manner Unto my daughter Molly who is intermarried with James Bell to be paid out of the first monies arising $160. Unto my grandchildren William Davis & Mary Davis $10 each & that to be in full of all my estate having advanced their father Robert Davis & my daughter Nancy the full portion out of my estate in the exchange of land. Unto my granddaughter Mary the daughter of Alexander McMillan and my daughter Margaret and intermarried with John Cartwright the sum of $30. Unto my grandson William McMillan the son of said Alexander McMillian & my daughter Margaret the sum of $30. Unto my grandchildren the children of my sons James and Andrew McMillian and my daughters Janet Willoughby intermarried with Andrew Willoughby my daughter Molly intermarried with James Bell my daughter Elizabeth intermarried with James Fulkerson, all the residue of my estate to be by them equally divided share and share alike with provisa that all those of these mv grandchildren amongst them that bear my name William or my wifes name Mary shall each of them have $30 more than the others. And lastly I nominate & appoint my loving sons, Andrew McMillan & Francis McMillan joint Executors I have hereunto set my hand 8 Dec 1809. Which said clause by this Codicil I in so far alter that I give & bequeath out of said money in said will mentioned the sum of $100 in specie unto my said son James to be paid him immediately after my decease and I also give and bequeath unto my said grandson William the son of said James the sum of $20 in specie which said sums to be in full for what my grandchildren the children of my said son James might or could claim by said recited clause. I did not mention who was to receive the legacies left to my said grandchildren, during their minority, I hereby nominate & appoint the respective parents of my said grandchildren as guardians of this their bequeathed estate. I have hereunto set my hand this 10 September A.D. 1810.
