Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ********************************************************************** IN THE NAME OF GOD AMEN I, Andrew Willoughby, Senior of the county of Washington in the state of Virginia being weak in body but of sound mind and memory do make this my last will and testament in manner and form as followeth (Viz) First I recommend my soul into the hand of Almighty God hoping that through his mercy avils and mediration of my Saviour and Redeemer Jesus Christ I will receive a happy immortality and resurrection among the just and as to my body I allow it to be buried in a decent manner at the descresion of my executor hereafter mentioned and as to my real and personal Estate that it hath pleased God to bless me with I devise it as followith And first I give and bequeath unto my well beloved wife Elizabeth her maintenance right of dower in the improved part of the land I now live upon also her bed wearing appearel and kitchen furniture to be hers and at her disposal I give and bequeath to my son Matthew WILLOUGHBY the plantation I now live upon containing three hundred and thirty acres also one other tract joining containing two hundred forty acres with cleir appurtenances to him and his heirs forever on the condition that he pay to his sisters Sarah, Hannah and Jean each eight hundred and sixteen dollars and sixty seven cents or if he does not chose to pay that sum to each or if they would reather choose land he is to make a title in fee simple to his sister Sarah for seventy five acres of the Dower and of the tract of three hundred and thirty acres and a title also in fee simple to his sister Joanna for seventy five acres joining Sarah in a direct line from the line that joins DONALD tract to the line that joins Samuel VANCE and also to make a title in fee simple to his sister Jean for one hundred fifty acres of the two hundred and forty acres met the knobs and also do make unto his brother Andrew WILLOUGHBY a title in fee simple for a tract of one hundred and eighteen acres of his that joins the above mention tracts or pay him in the sum of three hundred and ninety three dollars and thirty four cents which even the said Matthew WILLOUGHBY will chose to do. I also will and bequeath to my son Wallace WILLOUGHBY a tract of land lying on Sinking Creek in Sullivan County state of Tennessee containing two hundred and seventy two acres being part of a tract of land of three hundred and forty two acres granted to the said Andrew WILLOUGHBY by the state of North Carolina registered in Sullivan County bearing date the 10th day of October 1783 to him and his heirs forever. I also will that my three daughters Sarah, Joana & Jean do pay out of the legacies that I left to them each to my grandaughter Elizabeth BRECKENRIDGE thirty three dollars and thirty four cents and to my two granddaughters Mary WILLOUGHBY, my sons William and Andrew's daughters, to each eleven dollars and nine cents. I also will and bequeath to my three daughters before mentioned to each out of my moveable estate a horse of the value of eighty dollars also their bed and furniture wearing apparel and chests also two cows and all the remainder of my Real and personal that is not particulary here divised. I devide and bequeth to my son Mathew WILLOUGHBY on this requister that he take charge and care of his mother during his natural life upon him and I do appoint my son Mathew WILLOUGHBY and my friend John CAMPBELL executor of this my last will and testament hereby revoking all former wills by me made declaring this to be my only last will and testament In witness wherof I have hereunto set my hand and seal this sixth day of July 1799. Signed seald and acknowledged in presence Andrew WILLOGHBY L.S. Test Lawrence VANCE, Senr., John VANCE, Wm. N. CALE At a court held for Washington County the 18th day of November 1800 This last will and testament of Andrew WILOUGHBY deceased was exhibited into court and proved by the oaths of Samuel VANCE, John VANCE & Wm. N. CALE the subscribing witnesses thereto and ordered recorded. And at a court held for said county the 16th day of December 1800 on motion of Mathew WILLOUGHBY & John CAMPBELL the executors named in the last will and testament of Andrew WILLOUGHBY deceased who took the oath of executor prescribed by law and together with James PIPERS and John DAVIES entered into and acknowledged a bond in the sum of two thousand dollars conditioned as the law directs A certificate for the probator of the said will is therefore granted them in due form.
