Westmoreland County, Virginia, Deeds and Wills Book One (1653-1671), page 317: Spencer & Wife ) Know all men by these presents that we Nicholas and Francis To ) Spencer of nomony in the county of Westmoreland doe hereby Payne ) bargain alien and sell and have hereby bargained aliened and sold from us our heirs Ex'ors Adm'ors and assigns unto John Payne of Machotecks of the aforesaid County his heirs and assigns for the consideration of four thousand pounds of tobacco and cask to us already paid all our right title and Interest of a tract of land granted by pattent unto the said [page 318] Payne bearing date the 1st day of June 1664. part of which said land is by survey found to be within the bounds of a tract of land of two thousand five hundred Acres lying at the head of nomony by pattent bearing date February 26th 1653. formerly granted unto Thomas Hawkins Sen'r and since by Thomas Hawkins Jun'r son and heir of the said Thomas Hawkins Sen'r aliened and sold unto us Nicholas and Francis Spencer our heirs & assigns as by conveyance bearing date the 20th of September 1665 as p'r the records of Westmoreland County doth appear we say we do and have hereby aliened and sold from us our heirs unto John Payne his heirs and assigns all the land formerly and commonly called John Paynes [here the clerk wrote "with" then lined it out] which doth appear to lye and be within the bounds of the land formerly known and Called Mr. Hawkin's land as the course of the said Paynes pattent and marked trees doe make appear which aforesaid land by us hereby aliened and sold we doe hereby oblige ourselves our heirs Ex'ors Adm'ors and assigns to defend and make good unto the said John Payne and his heirs from the Just claim and demand of every person and persons whatsoever In Testimony whereof we have hereunto set our hands & Seals this 14th of September 1667.
