This sale of land was acknowledged in Court by the said John Payne and then recorded. [Notes: (1) The clerk transcribed the original records into a new book in 1801-1802. The original county records are no longer extant. Deeds and Wills Book One has this note at the beginning: Deeds Wills pattents ye pc Begun September 18th 1801 and Finished 18 January 1802-- By order of the County Court of ) by Wm Spence Westmoreland ) for ) Jos. Fox Jun CWCounty (2) The record of the original 1664 patent to John Payne has been transcribed and posted in the Westmoreland County, VA, USGenWeb archives. Comparing the older record to this later transcription, it seems that the clerk in 1801 probably did not transcribe the original records exactly as they had been written. (3) The surname of John Payne's partner appears to be spelled as "Morphue" in this record, while it appears to be spelled as "Morphew" in the will of John Payne. Both this land sale record and the will are later transcriptions of the originals, done in 1801-02. In the Westmoreland Co., VA, county court orders book covering the period 1690-98, at page 152, is the record of the proving of the will of Cornelius "Murfee" on 31 Oct. 1694. The court orders book is the original, so it seems probable that the partner's surname was Murfee, or what we would now spell as Murphy. Apparently the transcriptions done in 1801-02 changed the spelling because of the difficulty in reading the original record.] Submitted by: Robert W. ("Bob") Meadows Copyright 2003.
