WESTMORELAND COUNTY, VA - DEEDS - William Payne Jr. to Francis Awbrey, 12 February 1721/22 --------------¤¤¤¤¤¤-------------- Westmoreland County, Virginia, Deed Book 7, page 354: [In the left margin next to this entry is "Paynes Sale to Awbrey."] This Indenture made this 12th day of Febry in the eighth year of the reign of Our Soveraign Lord George by the grace of God of Great Britain France and ireland King defender of the faith etc. and in the year of our Lord God One thousand seven hundred and twenty one Between William Payne Jun'r of the parish of Cople and County of Westmoreld of the one part and Francis Awbrey of the parish and county aforesaid of the other part Wittnesseth that the aforesaid William Payne Jun'r for and in consideration of the sum of five pounds current money of Virginia and Seven thousand pounds of Tobacco to him in hand paid by the above named Francis Awbrey the receipt whereof he doth hereby acknowledge and thereof and of every part and parcell thereof doth acquitt exonerate and discharge the said Francis Awbrey his heires and assignes forever hath given granted bargained sold aliened and enfeoffed and by these presents doth give grant bargaine sell alien enfeoff and conform unto the aforesaid Francis his heires etc. all his right title and interest of in and unto a certain parcell of land situate in the county aforesaid containing by estimacon one hundred acres be the same more or less and is part of a Pattent formerly granted to John Payne grand father to the aforesaid William party to these presents for four hundred acres of land and by the John by will bequeathed to John Payne father to said William Payne Jun'r and by the said John Payne by his last will and testament given to his two sons John Payne and William Payne party to these presents as is aforesaid to be equally divided between them To have and to Hold the aforesaid one hundred acres of land be the same more or less and all and singular the premisses herein menconed or intended to be hereby bargained and sold with their and every of their [page 355] appurtenances unto the said Francis Awbrey his heires and assignes forever and I the said William Payne Jun'r for myself my heires etc. the aforesaid Land and premisses together with all houses Out houses edifices Orchards gardens fences ways water and water Courses priviledges and appurtenances unto the said One hundred acres of land belonging or in any wise appertaining unto the aforesaid Francis Awbrey his heires executors administrators or assigns shall and will warrant and forever by these presents defend against the claim or claims of any maner of person or persons claiming or pretending to claime by from or under me In Confirmacon whereof I have hereunto sett my hand and affixed my seale this 12th day of Febry 1721 William Payne (seal) sealed and delivered in presence of us William Lynd, Elias Martin, John Awbrey-- Memorandum that on the 12th day Febry 1721 the within named William Payne Jun'r did deliver to the within menconed Francis Awbrey the within menconed land and premisses by Turff and Twigg in token of livery and seizin in presence of us John [Hammark ?] John Morris Edward [Harrys ?]-- Westmoreld } At a court held for the said county the 25th day of July 1722-- William Payne personally acknowledged this sale of land from him to Francis Awbrey together with livery of seizin to be his proper act and deed, which at the instance of the said Awbrey was admitted to record-- Test Tho Sorrell [Clerk County of Westmoreland] Recorded Septemo die Aug'te 1722 [P Eundm Cluum ?] [Notes: (1) The original records are no longer extant. The county clerk transcribed the original records into new books in the 19th century. Some parts apparently were not accurately transcribed. For example, this entry clearly states that the King of Great Britain and Ireland also claimed the throne of France, but I have found no historical basis for including France in the title of King George. (2) The name of the grantee would probably be spelled as Aubrey today, but the clerk clearly spelled it as Awbrey in this entry. (3) I have enclosed in brackets after the name of the original clerk his title as Court Clerk of Westmoreland Co., VA. This entry as well as others in the book rendered his title as something that looks like "CluCompd". I found one entry that had the title as "CleeComWld" from which I realized the indecipherable part following the name of Thomas Sorrell in this entry was his title. (4) I have also put in brackets the indecipherable words following the date of recording along with question marks, since I cannot tell what they might be. (5) The entries in this later transcription of the original records into what is now Deed Book Seven are not in chronological order. At page 315, the clerk stopped entering 1723 records and started entering 1721 records in this book. As a result, the power of attorney signed by William Payne's wife, Elizabeth, authorizing the relinquishment of her dower rights in this land was one of several records which were transcribed out of chronological order. The numbers of the pages on which the power of attorney appears in this same book are 286 and 287--68 pages earlier in the book, even though it was recorded one year later than the deed.] Submitted by: Robert W.
