I, James Hunter of the County of Westmoreland, Virginia being weak of Body but of Sound mind and perfect memory calling to mind the uncertainty of life, do make this to be my last Will and Testament, bequeathing my Soul to God and my body to be decently buried, and as to the worldly Goods which it hath pleased God to endow me with, I leave in manner and form as followeth, viz. Imprimis: It is my Will and desire if my dear Wife Winefred remains unmarried until the year One thousand seven hundred and eighty eight at which time my son John will be twenty one years of age on the Twenty third of September of the same year. I say in such case it is my Will and desire that all my Estate real and personal remain whole and undivided for the use and behalf of my dear Wife and children. Item: In the year One thousand Seven hundred & Eighty Eight on the Twenty third of September of the Same year it is my Will and desire that all my Estate real and personal shall then be divided, after deducting my Dear Wife’s thirds. I give my sons Will & James each of them Ten pounds Cash more than the rest of my children, and all the remainder of my Estate Real & personal I give to be equally divided amongst all my Children that shall then be alive, but if they should not agree about dividing the negroes it is my Will and desire that they be set up to publick Sale & Sold and the money arising from Said Sale to be equally divided amongst them. Item: But if my dear Wife Winefred should marry any time before the year One thousand Seven hundred & Eighty eight then it is my Will and desire that the division I have already mentioned shall take place immediately upon her marriage. And I do hereby appoint & constitute my Dear Wife Winefred Executrix & John Carter and Thomas Eatman Executors of this my only last Will and Testament. David Wardrobe Benjamin Hackney William Gray At a Court held for Westmoreland County the 30th day of June 1778, this Will was proved according to Law by the Oaths of Benjamin Hackney and William Gray to of the Witnesses thereto and ordered to be recorded and on the motion of Winefred Hunter the Executrix therein named who made Oath thereto and together with John Carter & Thomas Yeatman her Securities entered into and acknowledged Bond and Condition as the Law directs certificate is granted her for obtaining a probate thereof in due form.
