WILLIAMSBURG, VA - WILLS - Goodrich Durfey, 4 Dec 1867 --------------¤¤¤¤¤¤-------------- His will is recorded in Williamsburg, Virginia, on the 4th of December, 1867 with a codicil on December 6, 1868 and was retrieved by DURFEY researcher Ginny Grubbs: In the Name of God, Amen: I, Goodrich DURFEY of the City of Williamsburg, State of Virginia do make this my last will and testament hereby revoking all others, First I give to my son Zachary DURFEY, either the farm on which I now reside, that is to say, the land purchased by me of John COKE, formerly owned by Burwell BASSETT*, containing about three hundred and eighty-one acres, with all the buildings thereon; and valued by me at eight thousand dollars, ____ or my farm in James City County called "Jockey's Neck" containing about five hundred acres, and valued by me at Five Thousand dollars the choice to be made by my said son Zachary DURFEY when he shall arrive at the age of Twenty One. Secondly In case my son the said Zachary DURFEY shall elect the farm first herein, named, I give and bequeath to him the sum of Two thousand Dollars or if the last named farm, the Sum of Five Thousand Dollars in addition to the real estate which he may so elect, and whatever else he may receive under any subsequent clause of this my will, thus making his portion herein before named. Ten Thousand Dollars in either Case. Thirdly I give and bequeath to my daughter Elizabeth NIMMO DURFEY, Five Thousand Dollars to her and her heirs forever, I have given to my daughter, Margaret G. LEA (wife of Col. J. W. LEA) by deed, a tract of land called "Morris" containing by estimation one hundred and fifty acres, valued at two thousand Dollars and one half of the "Newport Mills" with land improvements &c. which I value at the time, at three thousand dollars----thus making her portion of my estate--already received, equal to that herein bequeathed to my daughter Elizabeth NIMMO DURFEY. Fourthly I give and bequeath to my children's Aunt Elizabeth HUNNICUTT Two hundred Dollars and request that she may live with one of my children, as she and they may elect, during her life, free of all charge for board. Fifthly I authorize and empower my Executors hereinafter named or Such as may execute this will, to rent out my two farms herein named, to good tenants (who shall be required to keep them in good order) until my son the said Zachary DURFEY shall arrive at the age of Twenty one and make Choice of them, as herein before indicated; then they shall sell the farm not so elected, together with any and all the real estate not herein before devised belonging to me, at such time and in such manner as they may think best for the interest of my Estate and apply the proceeds in payment of my debts and legacies; Sixthly After the payment of my debts and the legacies to my son Zachary, and my daughter Elizabeth NIMMO, and to their Aunt Elizabeth HUNNICUTT, I give___ devise and bequeath to my said son Zachary DURFEY and my said daughter Elizabeth NIMMO DURFEY, and my daughter Margaret G. Le, named in the third clause of this will, all the rest and residue of my estate, real and personal, to be equally divided between them my household furniture however, I bequeath to my Son Zachary DURFEY and my daughter Elizabeth NIMMO DURFEY to be equally divided between them, or sod, and the proceeds equally divided as their Guardians may think best. I have already given my daughter Margaret G. LEA her portion theirof. (Sic) Seventhly. I appoint my friend James W. CUSTIS, my son in law Col. Jno. W. LEA, and my Son Zachary DURFEY, when he shall arrive at lawful age, Executors of this my will. Eighthly I wish that all rents and profits accruing from my Estate, real and persona, shall be received by my Executors and considered as part of my Estate until my son Zachary DURFEY shall come of age, and that until that time any expenditures which may be necessary for the support and education of my son Zachary and my daughter Elizabeth, shall be made out of funds belonging to my estate, and not made a charge against their portions herein before named. In witness whereof I have hereunto set my and seal in the presence of two witnesses this fourth Day of December 1867 G. Tho. P. MCCANDLISH R. MCCANDLISH Codicil: In View of the feeble health of my good friend James W. CUSTIS and with undiminished confidence in his willingness to serve me I hereby appoint Thomas P. MCCANDLISH one of my executors in his stead and further request that my son Zachary DURFEY shall be allowed to qualify without Security. When my grandson William Mead LEA shall arrive at the age of eighteen, I wish the sum of Two hundred dollars appropriated by my executors toward buying a watch for him as a present from me. Said sum of Two Hundred Dollars to be received by my son in law John W. LEA, at the settlement of my estate, for the purpose above named. Done at Williamsburg this 6th day of December 1868.
