The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** DEED: Wythe Co Deed Book 12, pg. 650 James Davis to Isaac Patterson Contributed for use in USGenWeb Archives by Becky Sowers bsowers@i-plus.net This Indenture made this seventeenth day of August in the year of our Lord one thousand eight hundred and thirty three between James DAVIS and Rachel his wife of the County of Giles and state of Virginia of the one part and Isaac PATTERSON of the County of Wythe and state aforesaid of the other part witnesseth that for and in consideration of the sum of two hundred Dollars lawfull money of the Commonwealth to them in hand paid by the said Isaac Patterson at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged by the said James Davis and Rachel his wife have bargained and sold and by these presents doth bargain and sell unto said Isaac Patterson one certain tract or parcell of land lying on Walkers Little Creek containing one hundred acres (more or less) being the upper end of a survey purchased by said Davis of John Alford and bounded as followeth (to wit.) Beginning at a white oak dogwood and black oak on the old line with the same 5.55° W 45 poles to a white oak hickory and dogwood S 42° W 54 poles to a white oak S 68° W 32 poles to three oaks and hickory in a draft near Drapers path 5.88° W 63 poles to a white oak and pine on the north side of Walkers little mountain N 20° W 30 poles to a pillar? and two small hickories in a bottom N 26 poles to a white oak and hickory sapling N 25° E 60 poles to a white oak maple and hickory on the south side of the long spur N 60° E 66 poles to a chestnut oak on the top of long spur and on the old line corner to the line of division and with the same S 59° E 118 poles crossing the creek to Beginning----To have and to hold the said land and all its appurtenances and singular privileges thereunto belonging or in any ? appertaining to the sole use and behoof of him the said Isaac Patterson and his heirs and the said James Davis and Rachel his wife for themselves and their heirs the said land free from the claim or claims of all and every person or persons whatsoever will forever warrant the said land. In testimony whereof the said James Davis and Rachel his wife have here unto set their hands and affixed their seals the day and year first above written. OVERSTREET of the other part both of the county of Giles & state of Virginia in witnesseth, that the said James DAVIS & Rachel his wife hath for and in consideration of the sum of five hundred dollars, to him hand paid the receipt is whereof is hereby acknowledged, bargained, sold and confirmed and by these presents, do bargain, sell and confirm unto the said James C. OVERSTREET, his heirs and assigns forever, a certain tract or parcel of land being in the county of Wythe, on little Walkers Creek, containing one hundred and eighty three acres, and being the lower end of the tract of two hundred and eighty three acres, which I bought from John Alford, and bounded as follows, to wit Beginning at a white oak, hickory and pine on the north side of little Walkers mountain and running thence N 20 W 30 poles to a popular & two small hickories in a bottom, N 26 poles to a white oak & hickory sapling N 25 E 60 poles to a white oak, maple and hickory on the south side of the Long spur, N 60 E 120 poles to a white oak and chestnut, N 15 W 28 poles to a white [blank] on the top of the said spur N 64 W 70 poles to a white oak S 75 W 40 poles to a maple, dogwood and white oak N 40 poles to a white oak on the north side of the little fork, S 80 E 60 poles to a white oak and hickory N 75 E 26 to a large white oak & hickory N 85 E 150 poles to two dogwoods by said fork, S 60 E 18 poles to a large white oak in an old field, N 67 E 20 poles to two white oaks at the foot of the pine ridge S 80 E 84 poles on a steep hill N 40 E [blank] to William ALFORD'S corner, thence southward to a pine S 12 W 32 poles to a double spanish oak S 60 W 40 poles to a white oak S 25 W 34 poles to [blank] S 70 W 40 poles to a white oak and hickory sapling west 40 poles to a large spanish oak & white oak N 80 W 32 poles to a white oak, hickory & dogwood S 42 W 54 poles to a white oak S68 W 32 poles to three white oaks & hickory by DRAPER'S path, and thence along the foot of the mountain to the Beginning: to have and to hold the said tract or parcel of land with all and singular the appurtenances thereunot belonging to the only proper use and behoof of him, the said James C. OVERSTREET, his heirs or assigns forever. And the said James DAVIS & Rachel his wife for themselves, their heirs and assigns, the said tract of land with all and singular the appurtenances thereunot belonging unot the said Jas. C. OVERSTREET his heirs or assigns, against the claim or claims of all persons whomsoever, will forever warrant and defend.
