Ellis/Breeding Indenture, 1794 This Indenture made the first day of May One Thousand seven hundred and ninety-four between Richard Ellis and Susana, his wife, on the one part and Spencer Breeding of the other part, all of the County of Wythe and State of Virginia. Witnesseth that the said Richard and Susan Ellis for and in consideration of one hundred and thirty pounds lawful money of the said State of Virginia to them in hand paid by aforesaid Spencer Breeding the receipt whereof the said Richard & Susan doth hereby acknowledge that they, the said Richard & Susan, hath given granted bargained and sold and doth by these presents give grant bargain sell a lien enfroff(??) and confirm unto the aforesaid Spencer Breeding One tract or parcel of land containing One hundred and ten acres be the same, more or less, lying and being in the aforesaid County of Wythe on the North side of Little Reed Island Creek, a branch of New River being bounded as followeth to wit: Beginning at a white oak standing on a clift of said Creek & the mouth of a valley running up one side of the said valley along a line of marked trees to two white oaks & hickory saplings still along another line of marked trees to a large white oak at a hollow called The Chimney Rock Hollow down the said Hollow to a Sycamore tree on the said Creek at the ford and then down said Creek to the Beginning with all, and singular priviledges and appurtenances thereto belonging or in any use appurtaining unto the aforesaid Spencer Breeding, his heirs, executors, administrators or assigns to have and to hold occupy and enjoy the same to their own proper use and behoof free from the claim, challenge or Page 2 demand or any person or persons whatsoever and for them, the said Richard and Susan Ellis for themselves their heirs, doth covenant to and agree with the aforesaid Spencer Breeding and every of his (heirs) that they, said Richard and Susan, will and doth by these presents warrant and forever defend the said lands unto the said Spencer Breeding and his heirs and assigns forever. In witness whereof they, the said Richard and Susan, hath hereto set their names and affixed their seals this day & year above written. This Indenture of bargain and sale between Richard Ellis and Susan, his wife, of the one part and Spencer Breeding of the other part was acknowledged in Court by said Richard Ellis and on the passing examination of the said Susan, his wife, she relinquished her right of dower which is also ordered to be recorded.
