The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ In the name of God, amen, I, Peter Moyer of the County of Wythe and Commonwealth of Virginia being of sound mind and disposing memory, think proper to make my last will and testament, in manner following to wit: I desire that after my decease my personal property may be sold and my just debts be paid out of it, and the balance after pay of the legacies herein after directed to be paid out of the same, to be divided equally amongst all my children. Item: I give and bequeath to my two sons PETER and JOHN the tract of land I purchased of Petter Kittering containing about two hundred acres, my son PETER to have the upper end of said tract including the old improvements and the tract to be equally divided as to quantity without regard to quality. I also give and bequeath to my two sons PETER and JOHN, another tract of land, adjoining the former and being the same I purchased of Nicholas Cline, containing upwards of one hundred and sixty acres, to be equally divided between my sons PETER and JOHN according to quantity, without regard to quality--they paying such legacies as herein after directed to be paid by them which land I give and bequeath to my said sons PETER and JOHN to be enjoyed by them for ever. Item; I give and bequeath to my two sons MICHAEL and HENRY, the tract of land on which I present reside, lying on the South Fork of Reed Creek, being two surveys and containing in the whole about two hundred and eighty acres to be equally divided between my two said sons MICHAEL and HENRY according to quantity, without regard for quality, and to be enjoyed by them forever; they paying such legacies as are herein after directed to be paid by them. I give and bequeath to my son MICHAEL a good saddle from out of my personal estate. I give and bequeath to my son HENRY a good saddle horse, saddle and bridle, out of my personal estate. Item: I give and bequeath to my six daughters, namely, MOLLY, the wife of Martin Kegley, BARBARA, the wife of Martin Wyrick, PEGGY, CATHERINE, LEAH, and SARAH, one hundred and sixteen dollars and four shillings, each to be paid to them by my four sons PETER, JOHN, MICHAEL, &HENRY, in the following manner to wit: two hundred dollars to be paid by son Peter, two hundred dollars to be paid by my son John, two hundred dollars to be paid by my son Michael, and one hundred dollars to be paid by my son Henry, the whole to be paid within two years after my decease; except that part to be paid by my son Henry, which is not to be paid by him untill he attains the age of twenty one years, should he not attain that age within two years after my decease, one half of the said son's sum to be paid to my daughter as aforsaid shall be paid to them in Cash, the other half in good property. Item: I give and bequeath to my four daughters, Peggy, Catherine, Leah, and Sarah, two good cows and one feather bed and furniture to each of them, to be paid out of my personal estate. Item: It is my will and desire that my four sons Peter, John, Michael, and Henry shall give and furnish to my beloved wife Catherine a good, decent, and conmfortable maintainance and support during her life. Item: It has been my intention that my three sons, Peter, John, and Michael shall pay to my during my life, the sum of one hundred dollars each, are equally in consideration of my bequeathing to them the land before mentioned, now in my will and desire that should the aforementioned sum of one hundred dollars not be demanded of my said sons Peter, John, and Michael, and paid by them during my life, that the same shall be equally divided between all my children, the said Peter, John, and Michael retaining for themselves an equal share with rest. Lastly I constitute and appoint my friend Joseph Crockett, Esquire, Executor of this my last will and testament, hereby revoking all other or former wills and testaments by me heretofore made_____ In testimony of I have hereunto set my hand and affix my seal this_____day of ____ in the year of our Lord one thousand eight hundred and fourteen (1814). I, JACOB DOBLER, Senr of Wythe County in the State of Virginia, now of sound and disposing memory, do make this my last will in manner and form following; that is to say: First, it is my will that all my just debts and funeral expence be punctually paid and discharged. Secondly, it is my will that after the payment of my debts aforesaid that MARY, my wife shall have my negro boy named MOSES, and my negro girl named MARY and I give and bequeath the said negros slaves Moses and Mary to MARY, my wife and her heirs forever. It is also my will that MARY, my wife shall have the following property, to wit: 1 black mare with her colt, if she should have one two cows and 2 calves, 4 head of sheep, 8 head of hogs, chois of my stock one other beef cow or steer, all my meat, salt, and grain of every description or kind, all my hay, 1 woman's saddle, 1 riding bridle, 1 bed with it's furniture, 1 painted cupboard or kitchen dresser, all my cupboard furniture, including all my pewter, 2 brass candlesticks, 1 little wheel, 2 sheats, 1 small table, 1 tea kettle, 1 looking glass, 1 set of fire dogs, 1 pair of tongs, 1 hand bellows, 2 pots, and 1 dutch oven, 1 small skillet, 2 chairs, 1 shovel, 2 water buckets, 1 washing tub, 1 small tin trunk, 1 flax hackle, 1 brass wire sifter, 1 coffee mill, all my wool, flax, & thread, 2 pot hooks, 2 hogs head, 3 milk crocks, 1 watering pot, 1 bed stead without a bed, 1 garden hoe and spade, 1 ax, and I give and bequeath all the above mentioned property of every description or kind to MARY, my wife and her heirs forever. Thirdly, it is my will and order that Henry Hottel who I constitute and appoint to be my executor of this my last will, and shall, as conventiently he can after my decease, sell all the balance of my personal property and divide thee price thereof equally amongst my five children MARGARET VAUT, ANN COOK, SALLY MILLER, EASTHEN DAVIS, and SUSANNAH MILLER and the heirs of my daughter BETSY VAUT dec'd shall have her equal part equally divided amongst them 4th, I give and bequeath to my son in law MICHAEL CASSELL two dollars and no more for his share. 5th, I give and bequeath to my son JACOB DOBLER two dollars and no more. 6th, I give and bequeath to my daughter RACHEL MARSHALL two dollars and no more for her share. 7th, it is my will and order that Henry Hottel who I have appointed to be my executor of this my will, shall keep ANNE KOOK's equal part in his own hand, or put it into the hands of any person he may think proper and advance the same to her in such a sums and at each time as he may find that she stands in need of the same and if it should so happen that ANNE COOK should die while the whole or any part of her share remain not paid to her, it shall be equally divided amongst my five children named in the third section of this my will. 8th, If it should happen at my decease that I should have any money in hand or debts due to me, in that case, it is my will that my executor shall collect the same and pay the whole amount thereof to MARY, my wife and I give and bequeath the said money and debts to her and her heirs forever. And I do lastly make null and avoid all and every other or former will and acknowledge this to be my true last will and testament this sixteenth day of September one thousand eight hundred and seventeen.
