The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ Douglas Baker I, Dougls Baker, of the County of Wythe and State of Virginia, being of sound mind and disposing memory do ordain this instrument of writing to be my last will and testament hereby revoking all others. 1st- I devise that all my just debts be paid and in part for this purpose, I give to my son MONTGOMERY BAKER my entire tract of land subject to the life estate hereafter devised to his mother, no part which he is to dispose of during the life of his mother without her consent unless for the payment of debts against me all of which my said son MONTGOMERY is to pay and who is to have no interest in my personal estate, nor is he to be allowed any claim for debts which he may have paid for me. 2nd-I give to my beloved wife, MARY, one riding horse, saddle, and bridle, one cow, one bed and furniture such as she make choice of before there is any division of my personal estate of which she is to have one third part and to have during her life that part of my tract of land which I now occupy, known as the house or old part of my tract of land and containing about one hundred acres. 3rd-I devise that all my personal property remaining after that selected by my wife and devised to her, be equally divided among my daughters, PAULINA BROWN, ELIZA CRAWFORD, HAWTUTH UMBARGER, PATSEY SHARITZ, and CATHERINE TARTER. Lastly I do hereby constitute and appoint my wife,MARY executor and CHARLES CROCKETT executor of this my last will and testament. Given under my hand this 8th day of June 1847. Crockett Probate: Tuesday, Sep 14, 1847 This the last will and Testament of Douglas Baker Dec'd was presented in Court proved by the oaths of James Hutsell, Robert H. Crockett two of the subscribing witnesses thereto and ordered to be recorded and Mary Baker, this executrix named in the Will having appeared in Court and refused to take upon herself the burden of the execution thereof. On the motion of Charles L. Crockett, the executor named in this said will, who took the oath required by law, and together with John P. Mathews enterd into and acknowledged a bond in the penalty of $600 conditioned as the law directs, certificate is granted here for obtaining a probate of the said will in due form. Teste: J.P.
