Wythe County, Virginia - Will Book Number 7 (partial) Page 350 William Walters, Sr. I WILLIAM WALTERS, SR., of the County of Wythe and State of Virginia do make and declare this to be my last will and testament as follows In the first place I direct that my just debts and funeral expenses be paid 2d I give to my sons JOHN WALTERS and PEARSON W. WALTERS my entire tract or tracts of land on which I now reside to be divided between them by the division fence commencing at the lane on Southern end of the plantation and _________ [winding?] in a North direction to the Northern side of the plantationj adjoining the lands of my son MICHAEL WALTERS. My son JOHN WALTERS to have all that portion of my land lying west of the division fence and my son PEARSON W. WALTERS to have all that portion lying east of said fence, to them and their heirs forever upon the following conditions that my son JOHN pays my daughter ELIZABETH WALTERS fifty dollars within one year after my cease, fifty dollars to my daughter NANCY within one [?] year after my death, fifty dollars to my daughter MARTHA JANE within three years after my death, also to my daughter ________ [Catherine?] fifty dollars within the fourth year after my death also fifty dollars to my dughter NANCY within the fifth year after my death, also fifty dollars daughter MARTHA JANE within the sixth year after my death. I direct that my son PEARSON W. WALTERS pays to JAMES MADISON CALVIN, the son of ISAAC CALVIN Jr. one hundred dollars when he shall have attained the age of twenty one years, if he should live so long. If he the said JAMES M. COLVIN should not live to be twenty one years of age, then I direct the said sum of one hundred dollars to be equally divided between all my heirs. 3d. I give to my wife MARY M. WALTERS my entire stock of ____, hogs, sheep grain, household and kitchen furniture during her life, and at her death it is my will that whatever be remaining shall be equally divided between all my children. 4th The amount due me from my son MICHAEL WALTERS Jr of three hundred dollars it being for the land on which the sme MICHAEL WALTERS Jr now liveth. I direct that he oays to my daughter PHEBE NEESE one hundred dollars to my daughter CATHERINE REPASS one hundred dollars, to my daughter ANN ELIZA LINDAMOOD one hundred dollars. The words fifty dollars in the second clause of this instrument were erased before the execution thence I also give my wife MARY M. WALTERS all my stock of cattle. Lastly I appoint and constitute my sons JOHN WALTERS AND PEARSON W. WALTERS executors of this my last will and testament. And on the motion of JOHN WALTERS and PEARSON O. WALTERS the executors named in said will who took the oath required by law and together with MICHAEL WALTERS JR and ISAAC J LEFTWICH their securities entered into and acknowledged a bond in the penalty of $500 conditioned as the law directs certificate is granted them for obtaining probate of said will in due form. Teste William Walters [1784-1851] married Mary Magdalena Powers [aka Molly].
