Wythe Co., VA - Miscellaneous Wills ************************************ Will of William Hurst of Reed Island, Wythe Co., Virginia 22 January 1857/January 1861 Wythe Co. Will Book 10:83 I William Hurst of the County of Wythe and State of Virginia having arrived at old age, and attended with bodily infirmity, but of sound mind and disposing memory and being mindful of the uncertainty of human life, and desirous to dispose of all such worldly estates as it hath pleased God to bless me with, I do make this my last Will and Testament in manner and form following Viz: 1st I give and bequeath to my daughter Nancy Suthern a tract of land in the County of Carroll known as the Surrat place in this bequest I except a road from the ford of the creek about three hundred yards up the hill to the North East. I also give my daughter Nancy Four hundred Dollars in money. 2nd. I give and bequeath to my daughter Elizabeth Carnahan a tract of land in the County of Pulaski, the same whereon she and her husband now reside. I also give my daughter Elizabeth a Negro girl named Esther and her children. I also give my daughter Elizabeth a Negro boy named John and Two hundred Dollars in money. 3rd. I give and bequeath to my daughter Lucinda Hurst a Negro girl named Sally and her children. I also give my daughter Lucinda Hurst a Negro girl named Chana and her child named Nathaniel and I also giver her Two hundred dollars in money. [4th and 5th missing from will filed in Wythe Co.] 6th. I give and bequeath to my daughter Joanah Boyd a Tract of Land in Carroll County Known as the Hardy place, also a Negro girl named Esther and her children. I also give her a Negro boy named Baker by her paying to William F. Hurst Two hundred Dollars in money. 7th. I leave Tom and all other property to be equally divided between my five daughters, (to wit,:) (Nancy Suthern, Elizabeth Carnahan, Lucinda Hurst, Virginia Suhern [sic: Suthern] and Joanah Boyd) after the within amounts have been settled and all my just debts paid. [8th missing from will filed in Wythe Co.] 9th and last,, I hereby appoint my son-in-law Samuel Hurst Executor this my last will and Testament hereby revoking all or any other will or wills by me heretofore made in Witness whereof I subscribe my name and affix my Seal this 22 day of January 1857. This last Will and Testament of William Hurst deceased was presented in Court proven by the oaths of Newton Wheeler and Luke S. Thompson Subscribing witnesses thereto and ordered to be recorded. And the Executor named in said Will not being present, Jackson Breeding is appointed Curator of said estate and thereupon the Said Breeding together with Joseph Shaffer Jesse Honaker & Rufus F. Hurst his Securities entered into and acknowledged a bond in the penalty of three thousand dollars conditioned as the law directs and took the oaths prescribed by law. Teste H. S. (Martin?), Clk. Notes: Two known sons of William Hurst not named in the above will were Allen W. Hurst born ca. 1816 and William Floyd Hurst born ca. 1829. William Hurst was the son of Absalom Hurst and Elizabeth (unknown). Absalom Hurst, the son of Thomas and Mary Hurst, was born 15 May 1750 in Stafford Co., Virginia and died ca. 1829 in Wythe Co., Virginia. The marriage bond of William Hurst to Mildred Whitlock (da. of Thomas Whitlock and Hannah Phillips) was filed on 22 April 1805 in Surry Co., North Carolina. Mildred Whitlock-Hurst died at Reed Island, Wythe Co., Virginia on 8 June 1854 at the age of 70. William Hurst died at Reed Island, Wythe Co., Virginia on 15 December 1860 at the age of 82. ********************************************* James Black of Wythe Co., Virginia will 25 February 1805 In the Name of God Amen I James Black of the County of Wythe and Commonwealth of Virginia being old and Infirm but sound in mind and memory do Think proper to make this my last will and testament in manner and form following, First I recommend my Soul to God who Gave it in all Humble hopes of Salvation through the merits of Jesus Christ my Redeemer and as to such worldly Estate as God hat blest me with I have in in the manner and form following Vizt first I will that all my just debts and funeral charges be paid out of my personal estate. Item I leave unto my two daughters Mary and Nelly who now live with me the plantation I now live on the head of Swam branch waters of New River containing one hundred acres to be equally divided betwixt them by men indifferently chosen. Item I leave unto my Two daughters Jane wife of James Rodgers and Martha wife of James Louther Junr. one hundred acres adjoining The place I live on To be equally divided betwixt them by men indifferently chosen and Jane to have her Choice. Item I leave unto my son John Black one dollar to be paid by my Executors. Item I leave unto my daughter Ann(?) wife of Robert Porter one dollar to be paid by my Executors. Item I leave unto my daughter Betsy one dollar to be paid by my Executors. Item I leave unto Andrew Thompson one dollar to be paid by my Exects. hereafter to be named all of which to be paid out of my personal estate. Item I leave unto my Grandson Samuel Siblott son of my Daughter Jane now wife of James Rodgers Twenty pounds to be paid him when he comes to lawful age in the following Manner Vizt. Five pounds to be him by each of my Daughters that gets fifty acres of my land to witt Jane, Martha, Mary & Nelly. Item I leave unto my said two daughters Mary and Nelly Blacks all the personal estate I die possessed of off Horses Colts Sheep or hoggs and all my Household furniture & the same to be equally divided betwixt them by men indifferently Chosen In consideration of their taking care of me in my old age and lastly I constitute and appoint my said two daughters Mary and Nelly executors of this my last will and testament hoping they will take upon them the burthen of the same and I do hereby disannul all former will Made and acknowledge this only as my last will and testament in witness whereof I have hereunto affixed my hand and seal at pine Ru (???) I Samuel Hurst of the County of Wythe and State of Virginia being arrived at old age and attended with bodily infirmity but of sound mind and despairing memory and being mindfull of the uncertainty of human life and desirous to dispose of all such worldly estate as it hath pleased God to bless me with I do make this my last will and Testament in manner and form following Viz: 1st I give and bequeath all my personal property and real estate to my wife Lucinday Hurst during her life time. 2nd at the death of my wife Lucinday Hurst all my property is to be divided in five equal parts to be given to my heirs as follows to wit: (1) Casandra M. Breeding (2) J. M. Hurst (3) Sarah O. Tipton’s Children (4) Lucinday W. Williams (5) Rachel C. Owens I give and bequeath unto my son Rufus F. Hurst Five Hundred Dollars to be paid by the five before named heirs. W. R. Tipton is to pay one hundred Dollars more than any of the others, and W. R. Tipton is to have no control of any of my estate that I bequeath to his children that will be done by my Executors the one hundred Dollars extra before named is to be paid out of the estate that I leave to his children. And I appoint James Gardner of Carroll County State of Virginia my Executor and all my just debts is to be paid first before the money is divided or used in any other way. At the death of my wife Lucinday Hurst all my real and personal property is to be sold the land is not to be sold for the interest of no individual the heirs and Executor must consult and not sell until all agree it is for the best. R. Wheeler Virginia: In Wythe County Court June Term 1881. The last will and testament of Samuel Hurst dec’d was this day fully proved by the oaths of Henry Moore and W. R. Wheeler subscribing witness thereto and was thereupon ordered to be recorded: And on the motion of James Gardner the only Executor named in said will who made oath as the law directs and entered into and acknowledged a bond in the penalty of $800 -- conditioned according to law with A. J. Breeding and W. R. Wheeler his securities therein certificate is granted the said James Gardner for obtaining a probate of said will in due form. Teste W. B. Foster Clerk Notes: Samuel Hurst died of pneumonia on 9 May 1881 in Wythe Co., Virginia at the age of 72 years 8 mos. Samuel Hurst married ca. 1835 Lucinda Hurst, daughter of William Hurst and Mildred Whitlock of Wythe Co. One unnamed son in the above will, Allen Forest Hurst born 18 October 1843, Little Reed Island, Wythe Co., Virginia, enlisted in the Wythe Co. Militia 2 April 1862 and served in Co. K of the 54th Virginia Regiment throughout the Civil War. He was captured at Bentonville, N.C. on 19th March 1865 and imprisoned at Point Lookout, Maryland where he was released on 27 June 1865. Allen F. Hurst married Amanda (Mc)Cammack in Putnam Co., Indiana on 9 November 1872; moved to Greenwood Co., Kansas ca. 1880, and died in Kansas City, Missouri on 11 March 1929.
