Wythe Co., VA Miscellaneous Wills 1796 Aug 10 Will of William Calfee Wythe County, Virginia Will Book 1 pg. 185-186 August the tenth one thousand seven hundred & ninety-six In the Name of God amen I William Calfee of Wythe County and State of Virginia being in perfect mind and memory blefsed be God for it and Calling to mind the Mortality of my Body knowing it is appointed for all Men wonce to die do make and ordain this my last will and Testament that is to say principally and first of all I give and bequeath my Sole unto the hands of all mighty God that gave it and my body I Recommend to the Earth to Buried in decent maner at the discretion of my Executors nothing doubting that at the Resurrection I ____ the same again by the mighty power of God and now as touching such worldly Estate where with it hath pleased God to Blefs me in this life I give and dispose of the Same in the following manner and form I Give and bequeath unto my dearly wife Mary Calfee all my Negroes and all my horses mares and colts and all my cattle and sheep and hogs and still and all my household goods and estate utensils of every sort. That is to say. 1st I desire that all my just debts and funeral expenses be paid out of my estate as soon after my decease as pofsible 2ndly I give to my wife Jean one third part of my old plantation I now live on, the house and household furniture also four negroes Luke, Dinah, Jude & Patsey also one horse and one mare and plough and gears for two horse also two Cows and one third part of the hogs & sheep and one bed and furniture during her life or widowhood, and after her decease or marriage I give one fourth part of the same, the land and Dinah a negros woman expected to my two daughters Jeane & Mary and the other three-fourths to my 3 daughters Nancy Caty and Rodah to be by them enjoyed forever. 3rdly I give to my Son James Ten shillings and no more of my estate. 4thly I give to my son Henry the plantation I now live on to be bounded by a conditional line made by my sons Wilson and Henry up big Reed Island to include the saw and grist mills to be by him enjoyed forever, except the third part already given to my wife during her life or widowhood. I also give to my son Henry one negroe girl named Sall and two cows to be enjoyed as aforesaid. 6thly I give to my Daughter Mary one negroe woman named Luckey to be by her enjoyed forever. 7thlt I give to my daughter Martha ten shillings and no more of my estate. 8thly I give to my Daughter Nancy one black mare four years. Saddle and Bridle one bed and furniture and 2 cows the same to be enjoyed forever. 9thly I give to my daughter Caty one bay mare three years old saddle and Bridle one bed of furniture and two Cows the same to be enjoyed forever 10thly I give to my Daughter Rodah one brown mare, saddle and bridle and two Cows the same to be enjoyed forever. 11thly I give to my son Jamesses son Wilson eighty acres of Land lying in Grayson County on Lindseys path one Sorrel Colt three years old saddle & bridles and two year old heifers the same to be enjoyed forever. And lastly I do hereby constitute and appoint my friends James Calfee and John T. Sayers executors of this my last will and Testament hereby revoking and making null all other former wills and Testaments by me hereto made. True it is that I intended to let him have the Tract of lands but under the following conditions, that is to say provided he would reconvey to me the tract of Lands I now live on Known by the name of St. Clears place which I purchased of Edward Johnston and give to him and also relinquish his Rights to a family of Negroes I helped him purches and raised for him To Wit Pegg Joseph Frank Liddy Milly and George so it is and may it always be understood that if the said James Craig do make or cause to be made to my son John Craig, Jr. a Lawful right to the above Mentioned Tract of Lands Known by the name of St. Clear place containing by survey three hundred acres and also relinquish to my son Hiram Craig the above mention negroes (to wit) Joseph and Frank and to my Daughter Jane Allison (to wit) Pegg Milly Liddy and George that is my whole will and desire that my son James Craig shall have and for ever enjoy the Right and Interest of the well known place Hands Meadows containing by estimation two Thousand one hundred and six Acres. but on the contrary not to convey to my son John Craig, Jr. the Tract of Land Known by the name of St. Clears place and also to my son Hiram Craig the above named negroes (to wit) Joseph and Frank and to my Daughter Jane Allison the above Negroes (to Wit) Pegg Milly Liddy and George it is my whole will and desire that he have no more of my Estate and that I give and bequeath unto my son John Craig Jr. and my son Hiram Craig all of that Tract of land known by the name of Hands Meadows to be equally divided between them agreeable to Quantity and Quality and to pay Jane Allison three negroes to be of the value of the above mentioned negroes (to wit) Pegg Milly Liddy and George if they obtain and possess hands Meadows Item: It is my whole will and desire that all my Just Debts and funeral expenses be paid as soon after my death as possiable Item: It is my whole will and desire that my dear and beloved wife Molly Craig have all the benefit and interest of the plantation whereon I now live in case James Craig agrees to what I have before directed in this my will if not I desire and direct that she shall have all the interest and profits of the place and plantation known by the name of Han Meadows for and during her natural life also the use of my negroes (to wit) Aggy and her daughter Puggy and her daughter Esther and my negroe man London and also all my Horses Cattle Sheep and Hoggs and farming utencils household and Kitchen furniture and after her death to equally divide amongst my sons and Daughters except what is otherwise disposed off --- Item: It is my whole will and desire that my son David Craig have one still that he had now in possession and also one horse creature of the value of fifty dollars Item: It is my whole will and desire that after the natural death of my beloved wife Molly that my son John Craig have my negroe man named London also one tract of lands lying in Wythe County ajoining St. Clears place containing by estimation five hundred acres. Item: It is my whole will and desire that my son Hiram Craig have one tract of lands lying in Montgomery County Known by the name of P[D]owas(?) Place and also one horse creature of the value of fifty dollars -- Item: Whereas I have heitherto gave unto my Daughter Sinthea Statts one plantation known by the name of S[B]ente(?) Mathews ___________________________________________ 1813 July 21 Will of Halbert Allison Wythe County, Virginia Will Book 2 page 106-107 I Halbert Allison of the County of Wythe and State of Virginia do make this my last will and Testament - that is to say First it is my desire that as soon after my decease as possable all my just debts and funeral expenses shall be paid. 2ly I have already given my son James Allison a tract of land whereon he now lives, bounded by a line run by Mr Heazlerig and now do bequeath it unto him forever I also give unto him one negroe man named Nedd, reserving two hundred dollars of his value to be paid by him to my daughter Mary Davis to be half in money the other in good property. 3ly I give unto my son John Allison one hundred dollars in good property sides what he has already received. 4thly I give unto my son Francis Allison my land lying in [the County of Lee] 5thly I give unto my four sons, Charles Allison, Stephen Allison, William & Robert Allison the lands where I now live also my lands lying in Grayson County to be equally divided between them, reserving my house and the part where I now live for my son Charles. 6thly I give unto my two daughters, Rhoda Allison and Martha Allison one Negroe girl name Jinney also one negroe boy named London to be equally divided between them when they come of age, allowing my daughter Rhoda to keep the girl if she wants 7thly I leave unto my beloved wife Agnes Allison one negroe woman named Ann during her natural life and at her death to be equally divided between my two daughters Rhoda & Martha. I also leave unto my wife one meare saddle and bridel (her choice of all) it is also my desire that my wife shall have an equal part with my four sons in the land where I now live during her widowhood, I also leave unto my wife the best bed and furniture in my house. 8thly I leave also to my four sons Charles, Stephen, William & Robert Allison two negroe men Samuel & William to be equally divided between them 9thly It is my desire that the heirs of my three daughters Hannah Coles, Jean Brown and Pheaby Coles have $3 divided amongst them 10thly It is my desire that the remaining part of my estate be equally divided between my wife Agnes four sons Charles Stephen William & Robert and two daughter Rhodah & Martha Lastly I nominate constitute and appoint my wife Agnes Allison & my son Francis Allison Executrix & Executor of this my last will & testament making null and void all the wills & testaments by me heretofore made in Testamony in said County of Wythe this 21st day of July 1813 /signed/ Halbert Elson Signed Sealed delivered in presence of us James Calfee John Calfee Jr. Jno. Again I leave and bequeath to my son Charles Allison a negro man slave named Ned in consideration he shall pay a debt I owe to my son Francis Allison of one hundred dollars and purchase Ann a negro woman slave the wife of the said Ned now in my possession the value of sd. Crockett _______________________________________ 1820 Sept 9 Will of James Calfee Wythe County, Virginia Will Book 2 pg.334 In the name of God amen I James Calfee of the County of Wythe and State of Virginia being sick and Weak in body but of sound mind and disposing memory (for which thanks God) and calling to mind the mortality of human life and being desirous to dispose of all Such Worldly estate as it hath pleased God to blefs me with I give and bequeath the same in the manner following That is to say 1st I Desire that all my Just debts paid out of the perishable part of my property as Soon after my decease as it conveniently can be done. 2nd I give to my wife Jane Calfee a certain tract of the land I now live on during her natural life to a dividing line on the River bank beginning at a Lym tree thence a South Course crofsing a Waggon road about twenty poles to a White oak thence running a South West course along a marked line to a Spanish oak on a ridge thence running a South east Course to the East[?] line. 3rd I give all my Negro Slaves except one (my daughter Jane Calfee is to take choice of One) to my wife Jane Calfee during the time of her natural life and after the decease of my Wife I give my Slaves to my four daughters namely Polly Holmes, Jane Calfee Sally Calfee Rhoda Calfee to them and their Heirs forever to be equally divided among them except the One above mentioned my daughter Jane Calfee is to take is to take [repeated] choice of one of the above mentioned Slaves as soon as she thinks proper after my decease to have & to hold for her and her heirs forever 4thly I give all my Stock of every Kind and Household furnishings of every Kind (except so much of the Same as will be necefsary to pay my Debts) to my Wife Jane Calfee During her natural life and after her Decease to be equally divided between all my Children except my son John Calfee and all my farming utencils to be Disposed of in the Same manner as my Stock and household furniture But before a division of the above the property takes place I give my three Daughters Jane Calfee Sally Calfee and Rhoda Calfee and my two sons William Calfee and James D. Calfee each and every one of them one bed and furniture two cows and one horse. 5thly I give the eastern part of the land I now live on to the dividing line above mentioned to my son William Calfee and his heirs forever and the Western part of my land that I now live on to the dividing line above mentioned (after the decease of my Wife) I give to my Son James D. I give and bequeath the same in the maner following 1st I desire that all my just debts be paid out of the perishable part of my property as soon as it conveniently be done 2. I give to my wife Nancy Howard all my estate both real and personal during her natural life and after her decease it is to be equally divided between my seven children Patsey Howard, Cynthia Howard, William Howard, Rhoda Howard, Sophia Howard, James C. Howard and John Howard in the following manner (Viz) the whole of my land is to be equally divided between my three sons William Howard, James C. Howard and John Howard agreeably to quantity and quality the part or parcell of land lying the highest up the river I give to my son William Howard and his heirs forever the part or parcell of land lying furthest down the river I giv to my son James C. Howard and his heirs for ever and middle part or parcell of land on which my dwelling house stands I giv to my son John Howard and his heirs forever 3. I giv to my wife Nancy Howard liberty to giv any part of my personal estate to any of my above named children not exceeding the seventh part thereof the same being valued to them for which they shall give a receipt and at my wifes decease my whole estate both real and personal to be valued by disinterested persons and my three sons William Howard, James C. Howard and John Howard is to pay unto my four daughters Patsey Howard, Cynthia Howard, Rhoda Howard and Sophia Howard in two equal annual payments the same not to be due before they shall be twenty one years of age whatever sums their part of the estate shall amount to over and above what my above named daughters shall receive so that the above named Patsey Howard Cynthia Howard William Howard Rhoda Howard Sophia Howard James C. Howard and John Howard shall each receive an equal proportion of my whole estate as above mentioned. 4ly Neverthelefs if it shall appear to the satisfaction of my above named wife Nancy Howard that it will be an advantage to the above named heirs for to sell the above mentioned land she shall be at liberty to do so provided she will purchase land to the same amount again to be divided and disposed as I have directed the land I now hold named above.
