The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** York Co., VA, Wills & Inventories 18 (1732-1740), pp. 430-31 abstracted by Matt HARRIS [brackets & surname capitalization mine] In the name of God AMEN I Joseph MOUNTFORT of Yorkhampton Parish in the County of York being of perfect Mind & Memory and calling to Mind and duly considering the uncertainty of human Life make this my last Will & Testament First & principally I commit my Soul into the hands of my blessed Maker trusting in his Mercies and in the Merits of my dear Redeemer for the remission of all my Sins My Body I commit to the Earth to be decently buried as to my temporal estate I bequeath & dispose of it in the following Manner. Imprimis I give & bequeath to my Son Thomas MOUNTFORT the plantation commonly called Scasbrooks to him & his Male Heirs of his body lawfully begotten for Ever and twenty Shillings Currt. money. Item I give & bequeath to my Daughter Elizabeth JAMES one Negro woman named Grace. Item I give & bequeath to my Grand Daughter Lucy JAMES one Negro girl named Pat. Item I give and bequeath to my Son Zachariah MOUNTFORT the plantation I now live on and my half of the Mill and one Negro boy named Frank and one Negro girl named Phillis to him and the Male Heirs lawfully begotten for Ever (but my Will and meaning is) that if my Son Zachariah should dye in his Minority or without Male heirs that my Son Robert MOUNTFORT shall have the said Mill Land & two Negros before given to my Son Zachariah) Item I give & bequeath unto my Son Robert MOUNTFORT all that Tract or parcel of Land commonly called Bullocks and three Negro girls Judy and Nanny and Sue to him and the Male heirs of his body lawfully begotten for Ever, but if my Son Robert should dye in his Minority or without Male heirs, that my Son Zachariah should have the aforesaid Land & three Negros Judy, Nanny and Sue. Item I give & bequeath to my Son Robert my Sword & Belt and my Cain commonly called Curle. Item I give & bequeath to my Daughter Jean MOUNTFORT three Negro girls Dinah Betty & Amy but in case my Daughter Jean should dye in her Minority then my Will is that my two Sons Zachariah and Robert shall have the said Negros equally between them Item I give & bequeath to my Daughter Jane one Midling black Trunk and one young horse named Blase. Item I lend all the residue of and remainder of my Estate Lands and Negros Tenements Hereditaments with all my Goods Chattels Plate & Jewels Bonds Arrears of Rents with all other properties of what kind soever to me appertaining or belonging to my welbeloved Wife Rose MOUNTFORT during her widowhood And in Case she should Marry then [page break] My Will is that all the said Estate before lent to my said wife at the day of her Marriage be equally divided between my five Children and I do hereby constitute and appoint my welbeloved wife my Extrix and Edward CROSS & Thomas CARY jun.r my Extrs of this my last Will and Testament And I do hereby utterly revoke disallow and disanull all former bequests Will and Legacies by me heretofore in any wise left or made declaring ratifying and confirming this and no other to be my last Will and Testament In Witness whereof I have hereunto Set my hand & Seal this Sixth day of April one thousand Seven hundred & thirty eight Joseph MOUNTFORT *L:S* Sign'd Sealed published and declared } by the within named Joseph MOUNTFORT } to be his last Will and Testament in } presence of Us who Subscribed our } Names in presence of the said Testator} John WOOD } Edw.d POTTER} Chr. This last Will and Testament of Joseph MOUNTFORT dec.d was presented in Court by Rose MOUNTFORT & Thomas CARY jun.r two of the Extors therein appointed who made Oath to it and being proved by the Oath of Edward POTTER & Charles YEATMAN two of the Witnesses and the said Edward POTTER making Oath that he Saw John WOOD Sign his Name as a Witness thereto It was Order'd to be Recorded. And......at a Court held for York County July the 17.th 1738 this last Will & Testament of Joseph MOUNTFORT dec.d was further proved by the Oath of the s.d John WOOD the other Witness.
