The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** York Co., VA, Wills & Inventories 20 (1745-1759), pp. 413-14 abstracted by Matt HARRIS [brackets & surname capitalization mine] [margin note] MOUNTFORTs Will } In the Name of God Amen I Thomas MOUNTFORT of Yorkhampton Parish and County of York being Sick of Body but of Sound Mind and Memory praised be Almighty God do make and Ordain this to be my last Will and Testament in manner and form following Viz.t Imprimis my Will is that my Just Debts and funeral Charges be first paid then I give the remainder of my Estate as followeth Item I give and bequeath to my Son Joseph MOUNTFORT the Plantation on which I now live to him and the Heirs of his Body forever with five Negros Viz.t Ben a boy Joe a boy Beck & Phillis and the Child She is now big with to him and his Heirs forever but if my said Son should dye without Issue then my Will and desire is that it be equally divided between my two Sons Thomas and Wade MOUNTFORT. Item I Give and bequeath to my Son Thomas MOUNTFORT my Plantation at the Mill on which my father lived and five Negros Viz.t Frank Will Nanny Lydia & Grace to him and his Heirs forever I likewise give to my said Son Thomas fifty Acres of Land out of my Tract in Warwick County at the North end adjoining the land lately belonging to Jones IRWIN but if my said Son should dye without Issue then my Will and desire is that the Land as well as Negros be equally divided between my two Sons Joseph and Wade MOUNTFORT. Item I Give and bequeath to my Son Wade MOUNTFORT all the remainder of my Land in Warwick County and five Negros Viz.t Jack, Sue, Fann, George and Dick to him and his Heirs forever but if my said Son should dye without Issue then my Will and desire is that the Land as well as the Negros be equally divided between my two Sons Joseph and Thomas MOUNTFORT and the Heirs of their Bodies. Item my half the Mill commonly called Mountforts Mill I give equally among my three Sons and their Heirs and if either dies without Issue his part to be between the two Survivors and their Heirs forever. Lastly I do appoint my loving Son Joseph MOUNTFORT whole and sole Executor of this my last Will and Testament and desire my two friends M.r Edward CROSS and M.r Thomas PESCOTT one or both should be Guardian to my said Son Joseph until he arrives to the Age of twenty one Years and this I acknowledge to be my last Will & Testament whereunto I have set my hand & Seal this Sixth day of March One thousand seven hundred & fifty six Tho.s MOUNTFORT. And At a Court held for the said County the 17.th day of January 1757 Joseph MOUNTFORT the Executor therein named made Oath thereto and together with Higginson WADE William LEE and Edward BAPTIST his Securities entered into and Acknowledged Bond as the Law directs & On his Motion Certificate was granted him for obtaining a Probat in due form.
