Know all men by there presents that I, Ira CHURCH of Shaftsbury in the County of Bennington and State of Vermont for the consideration of 75 dollars received to my full satisfaction of James W. ELWELL of Bennington in the County of Bennington and State of Vermont do give grant, bargain, sell and confirm unto the said James W. ELWELL his heirs and assigns a certain tract or parcel of land situate in Shaftsbury aforesaid (and described) containing about five acres be the same more or less and being the same and all the land, this day deeded to me by Clark ELWELL & Sally ELWELL. Reference to their deed for furthur description description boundaries &c----To have and to hold the above granted and bargained premises with the appurtenances thereof unto the said James W. ELWELL his heirs and assigns forever, to his & their acontna----(?) benefit and behoof and also I the said Ira CHURCH for myself & heirs executors and administrators, covenant with the said James W. ELWELL his heirs and assigns that at and until the ensealing of there presents I am well sized(?) of the premises as a good and indefeasible state in fee simple and hence good right to bargain and sell the same in manner and form as above written and that the same is free from all incumberances whatsoever. And further more I the said Ira CHURCH do by then presents bind myself & heirs to warrant and defend the above granted and bargained premises to the said James W. ELWELL his heirrs and assigns against all claims and demands whatsoever. Provided nevertheless. That if the said Ira CHURCH his heirs executors or administrators pay to the said James W. ELWELL his heirs executors administrators or assigns the sum of twenty five dollars by the first day of October AD 1852 & 25 dollars by the first day of October AD 1853 & 25 dollars by the first day of October AD 1854 & the interest arising on the aforesaid sums which said sums are a part of the consideration money to be paid for the above described premises this day deeded to me by Clark ELWELL & Sally ELWELL to James ELWELL by their request. Then this deed as also three certain Nates bearing even date with these presents given by the said Ira CHURCH to the said James W. ELWELL conditioned to pay the sums at the times aforesaid shall be void atturcoin(?) shall remain in full force. In witness whereof I have hereunto set my hand and seal this 29 day of June AD1852----Signed and Sealed and delivered in presence of: Dennis J. GEORGE & Clark ELWELL. ELWELL the mortgagee written named having received full satisfaction of the mortgage money hereby discharge the same and said Ira CHURCH his heirs executors administrators and assigns therefrom forever.
