Judge A.L. Miller, attorney for the saloonmen filed a demurrer to the complaint admitting the facts alleged in the complaint but that no offense being committed under the Cushman construction of the law. The demurrer was argued Thursday and Judge Back rendered his decision this morning, overruling the demurrer, being a victory for the drys. The case will now undoubtedly go to the supreme court.
