In the answer the city claims the walk is in the same condition as when received by the city at th etime of incorporation,that the walk was not ina dangerous condition,that Allyn fell from a porch adjoining the walk,that he knew the condition of it and has passed over it on numerous occassions just prior to the time alleged injuries were sustained.And finally the city claims that Allyn was intoxicated when he fell. The case will probably not eb called at the jury term of court in June,as the docket is now crowded,there being 150 cases already docketed.
