Smith WILL--In the Name of God, Amen I Robert W. Smith of North Yakima, County of Yakima, State of Washington, of the age of Seventy-six (76) years, and being of sound and disposing mind and memory and not acting under duress, menace, fraud or undue influence of any person whatever, do make, publish and declare this my last WILL AND TESTAMENT, in the manner following, that is to say: FIRST I direct that after death my body be decently and properly (and as in the judgment of my hereinafter mentioned executor) burried and that a monument in accord to my station in life (as in the judgment of my said executor) be erected over my grave; the cost of which burrial and monument shall be paid out of the respective legacies of my sons Raymond W. Smith and Robert E. Smith, each to share in the full payment thereof; That all other just debts of my estate shall be paid by my executor out of and from the legacy herein provided for my son Raymond W. Smith. That after the payment of the debts of my said estate, as above provided, the residue of the several legacies hereinafter bequeathed to my sons, Raymond W. Smith and Robert E. Smith (if any residue remain) shall be set aside to each of them as herein provided and according to the true intent of this will. SECONDLY, I will and bequeath to my wife, Addie G. Smith the sum of one dollar. Thirdly, I will and bequeath to my daughter, Carrie J. Sheeley, nee Carrie J. Smith, the sum of One Dollar. Fourthly, I will and bequeath to my son Robert M. Smith all money, if any therebe, to the credit of testator, Robert W. Smith, in the Yakima National Bank of North Yakima, Washington and all balance due, if any there be, on a certain promissory note from John F. Mills and Janie Mills, his wife, to testator, Robert W. Smith, which note was made April 3rd, 1912 and payable March 1st 1913. And all of testator's interest in and to lot 6 in block 7 George Goodwin's Addition to Yakima City, Washington, according to the plat thereof on file with County Auditor for Yakima County; after reserving therefrom one half of said burrial expenses and one half of the (information not copied) Fifthly, I will and bequeath to my son, Raymond W. Smith, the following described land situated in Yakima County, Washington...containing Ten Acres of land, together with one-sixteenth of one share in the Wide Hollow and Shaw Canal..."the said land being my sole and separate estate--having been purchased by me from and with the legacy to me from my deceased father's estate. And I bequeath to my said son, Raymond W. Smith all stock and tools, and personalty of such nature (including whatever crops or feed stuff thereon) on said ranch and all other property of which I may die seized or have an interest in, to the full extant of whatever interest therein I may die seized, if any such there may be, of whatsoever nature of kind and wheresoever located and situated. Reserving, however, out of and from the said bequest of my said son Raymond enough to pay one half of my said burrial expenses and one half of costs of said monument as first provided; and reserving and excepting from his said legacy also enough to fully and completely pay all of my other just debts. LASTLY, I hereby nominate and appoint my son Raymond W. Smith the executor of this, my last Will and Testament and ask the court to accept him as such without bond and hereby revoke all former wills by me made.
