EARLY DOOR COUNTY DIVORCE CASES Abstracted by Sally Treichel **** 1861 - July 12 (File 1) FITTSHUER, Lydia - vs - FITTSHUER, Joseph Married 30 Nov, 1851 at Sloanesville, Schonnactedy, NY. He name before marriage was L.C. DAVIS. 3 children: Leroy - 8 yrs. old last Jan 15; Jane - 5 yrs. old last Sept. & Josephine - 3 yrs old on the 17 on this month (July). They came to Door County the spring or summer of 1856, settling in Town of Forestville. He deserted her on March 1, 1860. On Aug 16, 1860 he burned his house & left the state after threatening to shoot her. His wherabouts are unknown. **** 1865 - Feb 24 (file 24) HARTMAN, Alvina E - vs - HARTMAN, George A Married 10 March 1861 at Ahnapee, WI. Her maiden name was Alvina G. GREELY. (she signed her name Elvira Eliza GREELY). children: Catherine (Caty) Mary - 3 yrs. old last Jan & George Ephraim - age 1 on Jan 17 last (born after defendant left). Plantiff & children live with her mother & stepfather: Samuel (age 70) & Catherine CHAPPELL (age 52) in Town of Forestville. Defendant deserted her on April 23, 1863 & went to Chicago, leaving Chicago the previous summer. His residence is unknown. **** 1865 - Feb 24 (File 25) RACE, John - vs - RACE, Harrietta Ann Married 15 Sept 1857 at Town of Clay Banks. Her maiden name was FOSS & is a sister to Mrs. Samuel N. BACON. They lived in Ahnapee when she left him on Aug 20, 1863. She went to Chicago, then left Chicago, residence unknown although she has visited her sister several times since she left. **** 1866 - July 17 (file 76) BAKER, Elizabeth - vs - BAKER, George S. Married 2 May 1860 at Green Bay, WI. No children. They left Green Bay on the third day of their marriage & settled at Red Wing, MN. He left her on May 28, 1860 saying he was going to Pikes Peak. About 3 months later he sent a letter from Louis Annglois (sic), CA, saying he did not intend to live with her again & intended to start for England in a few days. His residence is unknown. She left MN in Dec 1864, returning to WI, Town of Sevastopol on Jan 9, 1865. **** 1866 - Feb 20 (File 82) GORDON, Catherine - vs - GORDON, William Married 8 March 1862 at Iowa Co., MI. She testified that he deserted her on April 1, 1862. She left Iowa Co, MI about the middle of April 1862 & went to Salem Center, Steuben Co, IN where she resided until Aug 1, 1864 - when she left IN and came to WI, Town of Sturgeon Bay on Aug 8, 1864. She also testified that he suffers from impotency & is entirely unable to procreate & take care of a wife in a proper & suitable manner. He testified that he denies all - says she left him on April 10, 1863 & has refused to return to him. Case is dismissed as the defendant has died. **** 1867 - July 18 (file 82) CADY, Esther Ann - vs - CADY, Albert Married 22 Oct 1863 at Town of Wahington, Door Co, WI. They are residents of Town of Liberty Grove. 1 child: Nathan Sherman CADY, age 1 yr 6 mos (age given on June 4, 1867). he deserted her on June 25, 1865 & neglected to support her or child. **** 1867 - Feb 20 (file 83) WRIGHT, Rufus M - vs - WRIGHT, Elizabeth D Married 11 March 1859 at Nyack, Rockland Co, NY. He testified that they lived together in NY until Aug 1862 when he came to WI & settled in Sturgeon Bay. (she agreed to his coming here to settle ). He said she deserted him at that time by refusing to live with him when he went back to NY several times to induce her to return to WI, even refusing to see him. When he went back again to get her in 1866 he was unable to find her or obtain information from relatives. he has written & sent money which she refused. In Feb 1865, while on furlough from the army, he went there, offered her money that she refused because it wasn't more. His brother Zenas Russell WRIGHT (in Sturgeon Bay since 1866) couldn't find her in NY in Aug 1866. Previously he found her at 252 West 26th Street & gave him a card, stating it contained her address & name she had assumed since she had become a physician. Name on the card was Mrs. Elizabeth DUDLEY, M.D. **** 1868 - Feb 27 (file 110) GREEN, Louisa - vs - GREEN, John W Married 25 Nov 1860 at Town of Lima, Sheboygan, WI. Her maiden name was JUDD. He abandoned her & didn't support her. She lived in Town of Bilraltar. His residence is unknown. (info. from marriage license: He was son of Samuel GREEN & Margarett ______, age 26 - born June 20, 1834 in Sterling, Cayuga Co, NY, farmer. She was daughter of Josiah JUDD & Loisa __________, age 17 - born Junly 22, 1843 in Milwaukee. Witnesses: Josiah JUDD & Jonathan JUDD). **** 1868 - Feb 18 (file 116) HOLLAND, Harriet L - vs - HOLLAND, Henry Married Aug 28, 1865 at Town of Ahnepee (sic), Kewaunee Co, WI. Her name before marriage was Harriet DECKER. She had 2 girls from her first husband: Harriet R DECKER age 11 in Oct next & another girl age 9. She testified that she left him Feb 10, 1866 & listed many instances of harsh, unkind & cruel treatment that started 3 months after marriage. He later kept her & her children locked in the house, watched them close & threatened to kill them if she left. He also threw a knife at her children. He left the house for a while on Feb 10, 1866 & she took the children & left, going to the nearest house 3/4 miles away. **** 1868 - July 25 (file 123) PETERSON, Soren - vs - PETERSON, Amelia Married 29, April 1864 at Chicago, IL. 1 infant child. He testified that she deserted him on Mar 6, 1866. She testified that he deserted her & sent her away, denies the charges & asks for no divorce. She now lives in Milwaukee. Her father is listed as J.L. CULMSEE. (The court found that she willfully deserted) **** 1868 - July 27 (file 125) DECKER, Mary Ann - vs - DECKER, John Married Oct 1855 in Alleghany Co, NY. They moved to WI in 1859. 5 children: Ella Elizabeth - age 11; Hattie Leora - age 8; Susan Alice - age 4; Caroline Maria - age 2 & Effie - age 1. She testifies that he abandoned her on Nov 1, 1866. He denies charges, said she abandoned him Nov 1866 & that he has always supported her to the extent of his ability & has always been willing to live with her & support her & children. He testifies that in Dec 1867 at the Town of Washington & other times & places since, she has committed adultery with Jacob YOUNG & since then has been living with Jacob YOUNG at the Town of Washington in a state of adultery. (case is dismissed) **** 1868 - May 9 (file 129) PFISTERER, John - vs - PFISTERER, Anna C Married 17 May 1863 at Green Bay. They resided in Door Co. On Aug 1, 1864 she deserted & went to Green Bay. (his sister Margaretha BINK also testified). **** 1869 - July 21 (file 134) (see also file 125) DECKER, Mary Ann - vs - DECKER, Joseph Married 11 (or 12) Nov. 1856 at Alleghany Co, NY. They came to Door Co in 1860 or 1861. 5 living children: Ella Elizabeth age 12; Hattie Leora - age 8; (Lyman DECKER - died); Susan Alice - age 6; Caroline Christina - age 4 & Effie - age 2. He now resides in Green Bay. She testified that he deserted her on Nov 1, 1866, is an habitual drunkard for several years, treated her in front of family & others with insolence & disrespect, has frequently abandoned her & family for days & weeks at a time. She lists dates of cruel & inhuman treatment in particular Jun 8, 1868, after 7 months gone, he returned in her absence, entered the home & destroyed furniture, broke dishes, carried away provisions, broke down the garden fence & drove the cow away. **** 1869 - July 22 (file 136) YOUNG, James H - vs - YOUNG, Catherine Married 28 Jan 1844 at Town of Victor, Ontario Co, NY. He testified that she deserted spring of 1859 in Town of Pentfield, Calhoun Co, MI. She had left him before for days & weeks at a time. She might be in Battle Creek, Calhoun Co, MI where her father is or at Henry, Henry Co, IL where her daughter Mrs. Inez MORGAN is. He resides in Sturgeon Bay, coming to WI in 1851. His mother, Sylvia YOUNG testified that defendant had a violent & irritable temper, discontented - not satisfied with anything or anybody. **** 1874 - Jan 26 (file 253) MASSE, Nellie L - vs - MASSE, John F S Married 22 Oct 1867 at Green Bay, WI. They lived in Green Bay until coming to Sturgeon Bay Jan 1, 1873. She charges him with cruel and inhuman treatment and testifies that he has struck, threatened and abused her by setting a large, cross bull dog on her and calling her names about her parentage, a reference to a mixture of Indian and white blood, also that he hung around saloons and drank a great deal. He puts all blame on her, that she wanted a divorce. She later became sick and wanted to come back to him, but he would then have nothing to do with her. **** 1874 - Feb 19 (file 254) JACKSON, Mary L - vs - JACKSON, Joseph Married 3 July 1868 at Brown Co., WI. They are both residents of Door Co., 2 children: David - age 4 and William Henry - age 2. She charges him with cruel and inhuman treatment and testifies that since July 3, 1869 he has been an habitual drunkard, and when in his fits of drunkeness, has repeaatedly committed acts of cruelty and violence towards her. On Dec 27, 1873 he forced her to leave the house and her children. She then went to her father Jacob CRASS. **** 1874 - Sept 22 (file 261) RICHARDS, Alfred - vs - RICHARDS, Elizabeath J Married 18 May 1870 at City of Mineral Point, WI. He now lives in Sturgeon Bay and is a painter by trade. 1 child: Theodora - age 3, who lives with deft. He charges her with desertion about Sept 15, 1872. Unable to find sufficient work at Mineral Point, he went various places for employment, but she refused to leave her parents at Mineral Point. When he returned to Mineral Point, she refused to live with him there. He has always sent money for her to join him and provides a home for her, but when she does join him, she always returns to her parents after a short time. It was ruled that she must support the child by herself. **** 1874 - July 15 (file 262) TORSTENSON, Nils - vs - TORSTENSON, J. Kirsten Married 16 June 1843 at Stavanger, Norway. They have both resided in Door County since 1851. He testified that she deserted him on July 1, 1870. she is now living with a grown son and refuses to live with him. **** 1874 - July 19 (file 295) SCOTT, Ellen - vs - SCOTT, John He navigates the waters of Lake MI & Green Bay. She had charged him with cruel treatment. He answered that he denied that she was a dutiful and faithful wife and denied that he treated her cruely. He testified that at various time during navigation season she would have companions of ill reput and disrespectible character, naming Thomas CARR, James REYNOLDS, John GASCOM & James MITCHELL. When he would return she would have deserted with children and everything from the house. She hid his son from him for some time. She would retun to him and promise to behave herself, which she would do for awhile. He admits pushing her, but denies striking her when she threated to strike him with a chair and spittoon when he objected to her bringing an intoxicated sailor home with her. The pushing occured when he took the objects away from her. He asks for a dismissal of the complaint. The divorce is not granted. **** 1875 - July 24 (file 313) WOLSKY, Caroline - vs - WOLSKY, Michael Married 17 April 1874 at Forestivlle. This case originated in Manitowoc County and was transfered to Door County where he was a resident of Forestville. She is 21 years of age and he is about 52 years of age. She complains of harsh, cruel and inhuman treatment, listing specific incidents. This treatment caused her to leave and return to her father on May 30, 1874. She also complains that he would not speak to her unless she spoke first and then he would answer her by calling her names. She also states that he would not sleep with her in the same bed and although she solicited it, they never had sexual intercourse and claims he would be impotent with any women. When the case was switched to Door County, she requested that he pay her attorney and give her weekly support money. This motion was denied. When the case came to court, she did not appear and the case was dismissed. **** 1877 - Feb 28 (file 362) ASTRAN, Mathilda S - vs - ASTRAN, Louis O Married 9 Aug 1874 at Ellison's Bay. Both lived in Liberty Grove. 1 child: John Frederick - age 1 year, 6 months. Pltf was age 14 on Dec 15, 1872, now is 18. She charges him with cruel and inhuman treatment and says from about 1 month after marriage, he has been an habitual drunkard. Many incidents were cited, including one where she became deaf from being struck and another where he struck her in the back with an ax. She left him on May 16, 1876 for her own safety and now resides with her parents in Liberty Grove. Witnesses to the treatment were brothers Louis J & John E NEMAN, both of Ellison Bay and her father Larson NEMAN of Liberty Grove. The judgement included that the homestead is to be sold and the court costs paid for & the rest of the proceeds to be applied ot her & her childs' support or it be given to her as a separate property. HGe is also to pay her $300 with 1 year. **** 1877 - feb 28 (file 366) CONDON, Bridget A - vs - CONDON, Edward Married 3 Mrch 1867 at Town of Sturgeon Bay. She lives at present at Menekaune, Oconto Co. but considers Door Co her home. No children. She is age 25 and he is about age 40. He abandoned her at Menekaune in July 1870. At that time he was under bonds to appear in Door Co. Circuit Court, charged with an assault with intent to commit a rape. He ran away and she has not seen or heard from him, and doesn;t know where he is. Her brother is listed as William AHERN **** 1878 - Feb 21 (file 395) RAMMAGE, Minnie F - vs - RAMMAGE, David L Married 3 Nov. 1873 at the Northwestern Hotel in Village of Sturgeon Bay. He abandoned her in Oct 1874. He now lives at Mr Shaw's lumber camp in Oconto Co. Testimony was given by employers that he has been steadily employed as cook and steward on various tugs and schooners, engaged in fishing and working as a cook in various lumber camps - drawing good wages and always had money. Testimony is also given that while married he never provided her with a home, money, clothing, food or the necessities of life except the fall of 1874 when he gave her $10 and $10 in clothing. They always lived with her mother Hermion C. CRANDALL. Her brother Fred D CRANDALL also lived there. She continues to live with them. **** 1876 - July 20 (file 475) RASMUSSEN, Elias - vs - RASMUSSEN, Jennie Married 9 Nov 1869 at Sevastoopol. 1 child: Jennie - age 4. He charges that she deserted him on May 1, 1872. He testifies that he lives in the Town of Sevastopol, coming here in the spring of 1866. They lived together in the Town of Sturgeon Bay at which time he was a carpenter and joiner. He was king to her and at times even helped her with the washing and house work. In the fall of 1871 he went to Peshtigo to get work. She was to join him if there was a chance to do so. There were no houses available, as many as 200 men sharing a shanty, so he wrote her not to come and that he would be back before navigation closed. When he returned as agreed, he found she had left Sturgeon Bay, had disposed of all household goods and furniture. He didn't know where she went. In the summer of 1872 she came back, promised to live with him, behave herself and act like a woman again. He forgave her and build a nice little frame house for her. While building it he gave her money for support and she lived in the Village of Sturgeon Bay. When the house was finished, she refused to live with him, stating that the place did not suit her, that she wanted to live in the Village. A few days after her refusal she left Sturgeon Bay without his knowledge. 3 years lataer, seeing letters she wrote to others, he learned she was in Stockholm, Sweden. She answers that he has been an habitual drunkard and has maltreated her, been brutal and abusive, applying abusive epithets to her and threatening her with violence and she was compelled to leave him. When she returned to him, he neglected to provide for her and child and she was forced to earn her own way. She later whithdrew the answer. Various wittnesses testified that he treated her very well, much better than she deserved, considering her treatment of him. Judgement was given in his favor. **** 1878 - July 27 (file 476) DAEMS, Henrietta - vs - DAEMS, Francis Married 25 Oct 1874 at the city of Green Bay by Father CRUD. No children. She charges that he has not provided for her and has never lived with her for more than a week or two at a time since their marriage. He deserted her on March 1, 1875. After their marriage they lived with Xavier GATTIE at Red River for a few days and he went to the lumber shanties and never returned. She worked for her board. In the winter of 1874 and 1875 she lived and worked at Joseph DEBECKERs in Red River for a few months. Deft. was working in the area but never came to see her. Others testified that when the shanties broke up, deft. was coming to work for DEBECKER but wouldn't come to work there as long as she was there. She then went to Antoine NANIOTs at Rosiere, Town of Brussels where she cares for an idiot child and does housework. She only saw deft. once from a distance in the Village of Sturgeon Bay. Others testified that when asked to pay for her board, the deft. refused, saying he would never live with her again and wouldn't pay a cent for her support. **** 1879 - July 25 (file 479) BOES, Hugo - vs - BOES, Emma Married 13 April 1878 at Town of Polk, Washington Co, WI. No children. They came here immediately after marriage. She left after they lived at Village of Sturgeon Bay about 2 weeks. He was gone at the time she left on May 3, 1878. She went to the house of Peter LORCH and after a few days took the stage to Washington Co. refusing to live with him again. She has never given a reason as to why she left him. One of the wittnesses, Chris LEONHARDT testified that his sister-in-law was formerly married to the pltf. The sister-in-law had children by a former husband. **** 1879 - July 25 (file 481) BARTLETT, Julia A - vs - BARTLETT, Robert Married 4 Feb 1866 at Sturgeon Bay. 3 children: George W age 12; Caroline age 10 and Maud Irene age 8. He deserted march 25, 1874. Other than sending about $3 worth of clothing by mail for the child Caroline on June 19, 1877, he hasn't contributed anything since he left. He sent her an abusive and insulting letter from Chicago on Jan 1, 1879. A great part of the time before his desertion, she was obliged to provide for the family on her own. She is a daughter of Mrs. Sarah W. TUCK where she has lived most of the time since he left. She gets custody of the children. **** 1879 - July 22 (file 490) DELAIR, Rose - vs - DELAIR, Edward Married 1862 at Forestville by John STONEMAN. 4 children: ages 13, 11, 7 and 4 (names not given). She is age 29. She charges cruel and inhuman treatment beginning the spring of 1878 until July 15, 1878 when he struck her with a butcher knife, causing a severe wound upon her arm. Earlier he threatened to kill her with an axe which he held over her. A neighbor testified that the deft. is a man of high malicious temper and an unsafe man for a woman to live with when he is under excitment. She gets custody of the youngest child. **** 1879 - July 26 (file 486) CAVANAH, Mary E - vs - CAVANAH, James Married 25 Nov. 1872 at her father's house in Town of Sevastopol. 1 child: Mary Ann - aged 4 years on Jan 12, 1879. He deserted them on July 2, 1874 at the Town of Liberty Grove. She has heard that he went to Michigan, but doesn't know where. He deserted her once before in Feb 1874 for a period of 9 weeks. That was about 2 months before he left for good. A witness testified that before he left, he was acting like a man half crazy, saying one thing one minute and contradicting himself the next. He said he couldn't live with her again. she is the daughter of Michael ARMBRUST. A witness Lawrence ARMBRUST is possibly her brother. She gets custody of the child. **** 1880 - Feb 19 (file 496) RABEYOR, Adolphine - vs - RABEYOR, Francis Married 3 March 1878 at the Catholic church in the City of Green Bay by the French priest. No children. She charges cruelty and desertion, listing many incidents of cruelty, tow of which caused miscarriages. On 12 Nov 1878 he went to Michigan, not intending to return. He is believed to be in Grand Haven, Ottawa Co., Michigan. She now lives at Ahnapee, Kewaunee Co. Her parents are John Joseph and Joasine MONTQUIN of Town of Brussels. 1880 - July 21 (file 528) BADE, Augusta - vs - BADE, George Married Nove 1877 at Sturgeon Bay. 2 children: one now deceased and one - age 2 years. She charges harsh, cruel and inhuman treatment, listing many incidents in the presence of strangers. She since learned that in Nov 1878 he was in the habit of visiting a house of ill repute in the Town of Sturgeon Bay, kept by one Joseph BERGMAN and staying at said house through the night. She is given custody of the child. 1880 - July 23 (file 532) ANDERSON, Hans N - vs - ANDERSON, Hulda Married 15 July 1856 at the City of Gragesoe, Norway. He is a resident of Ephraim for 6 years. He came to the US in 1871 with full understanding and agreement that she would also come, but she has refused by letter to come as agreed. He has repeatedly requested her to come and has offered to send sufficient means for her passage. 1881 - Feb 25 (file 548) LEONHARDT, Catharine - vs - LEONHARDT, Peter Married 18 July 1879 at Town of Forestville by John FETZER, Justice of the Peace. No children. They lived together from July 18, 1879 until Aug 8, 1880 when he drove her off. She charges him with cruel and inhuman treatment, using abusive and obscene language to her, tending to degrade her in the estimation of the public. She has had 2 miscarriages from the effects of ill treatment sustained at his hands. She now lives at the home of her father Anton THEISEN in Forestville and he lives in Brussels. **** 1881 - Feb 25 (file 549) BADER, Sarah Jane - vs - BADER, George Married 1 Jan 1873 in the parlor of Lewis POULs house at the Village of Oconto by Edwin HART, Justice of the Peace. They lived in Oconto 2 years next, after 1st of Oct 1873, otherwise she has been a resident of Door Co. 2 children: George Jacob Edward - age 7 years on Dec 31, 1880 and Emma Lilly - age 5 years on April 19, 1881. He deserted her and child Emma on June 9, 1876 at Town of Gardner. He took the son and said he was going to look for work and a home and would send for them as soon as he had money enough to do so. He left the son at the residence of his father in Green Bay on July 5, 1876 and went to Alma, Buffalo Co, WI. She received letters from him until Jan 29, 1877 saying he was leaving Alma but didn't say where he was going. She has not heard from him since. The son is still with the grandfather, who says the deft. is somewhere in Michigan. Since he left, he has only contributed $5 sent during July 1876. She is the daughter of Edwin and Catharine RILEY. **** 1880 - Feb 28 (file 554) HARDER, Fritz - vs - HARDER, Emmelia Married 30 June 1878 At Egg Harbor (marriage certificate says Ephraim). No children. She is charged with committing adultery with one John LAFOUNTAIN on several occasions at the house of Fred SCHNEIDER in the Town of Egg Harbor starting with Oct 15, 1879. She left pltfs. house and board on Aug 16, 1879 and has not returned. She is in constant habit of using abusive and insulting language towards him and on several occasions assulted him with dangerous weapons. He has been told that she is married to and living in adultery with said LAFOUNTAIN. (marriage license lists her maiden name as BRENNER). **** 1881 - July 19 (file 569) KAUFMANN, John - vs - KAUFMANN, Mary Married Oct 1864 in Brown Co, WI. Children: Charles - age 15; Edward - age 12 and Levi - age 9. She lives in Baileys Harbor. He charges her with cruel and inhuman treatment and adultery. She would not have meals ready for him, but he would find her drunk and intoxicated. She would beat and strike him, throw forks, knives, sticks of wood, an ax or anything else she could get her hands on. During Aug 1879 at various times she committed adultery with one John DOE (real name unknown) and since Aug 1879 she has been living with John DOE. Pltf. has not lived with her since the adultery was discovered. He gets custody of the 2 oldest children that live with him. She gets custody of the youngest who lives with her until further order. She says the deft. is not the father of the children. **** 1881 - July 27 (file 570) CROMWELL, N.N. - vs - CROMWELL, Mary A Married 5 July 1863 at City of Chicago. 2 children: George - age 17 and Carrie Bell - age 7. About June 1, 1874 she became insane on on Jan 1, 1875 she was adjudged insane by the County Judge and is an inmate at the Northern Hospital for Insane at Oshkosh. Doctors from the hospital testified describing her condition and conduct, stating that her quiet periods will never amount to a sane state, listing it as a chronic insanity, from which she will probably never recover. He is granted a divorce but is ordered to provide for the proper support and maintenance for her during her natural life. Her mother, who also testified is Rosetta HANKS. **** 1882 0 Feb 27 (file 607) OBRIAN, Mary - vs - OBRIAN, James Married 23 June 1880 at Village of Marinette. He deserted her on July 23, 1880. He has not supported her since their marriage. She was sick for a long time and had to be supported and cared for by her parents and later had to support herself. She does not know his wearabouts, but is informed that he left the state with the intention not to return. **** 1882 - Feb 27 (file 615) Arle, Emma - vs - ARLE, Joseph Married 8 July 1866 at City of Washington, District of Columbia. They became residents her Sept 7, 1874. 6 children: Mary - age 13; Madelone - age 11; Joseph - age 10; Emma - age 8; Wilhelm - age 5 and Lilly - age 4. She charges him with cruel and inhuman treatment (listing incidents) and since beginning of 1880, has been a habitual drunkard. She now resides at Williams Town, Oswego Co, NY. **** 1882 - Feb 28 (file 639) CROWLEY, Elizabeth - vs - CROWLEY, James Married 20 Oct 1881 in Sturgeon Bay. She complains that since their marriage he has treated her in a cruel and inhuman manner, making threats of violence, getting drunk, etc. and has told her to leave home. She state that on Apr 24, 1882 she was obliged to leave his home after he choked her, swore at her and threatened to kick and misuse her. Deft. answers and denies ill treatment of her and claims her cruel and inhuman treatment of him. He states that at all times she has a harsh, revengeful and ungovernable temper. He testifies that on Apr 24, 1882 she angrily blocked the door to his barn and when he gently removed her from the door, she struck him a violent blow to his face with her clenched fist and then deserted him. He also states she was usually absent from home, neglecting her duties on an average of 3 days each week. She has been gone every Sunday except 3 and that he and his employees have many times been compelled to go to the neighbors for their meals because she was gone. He lists several incidents of her being gone and other ill treatments. She counter claims that on Apr 24, 1882 when she was tending to her duties of feeding and milking the cows in the barn, he choked her and other assaults and she tried to push him away. She also states that anytime she left the house it was with his consent and that when she was away on Sundays it was to attend church and always left prepared meals for him and the employees. He complains that she committed adultery at different times and places at Sturgeon Bay, especially on Feb 13, 1882 at Little Sturgeon with one Albert BEDDEL, also during Geb and March 1882 with other persons at present unknown to pltf. He found out about the adultery on March 16, 1882 when he found he had caughat a disease from his wife. When confronted, she confessed and left his house. She complains that since marriage he has treated her in a cruel and inhuman, manner, listing incidents. On June 7 instant he pushed her out of the house and demanded her to leave his premises. She also states that soon after marriage she delivered all of her personal praoperty to him which he applied and converted to his own use. she is now 53 years of age and is staying with her son and is destitute of clothing and means to support herself. **** Jan 31, 1883 (file 678) PAVOLIK, Granciska - vs - PAVOLIK, John Married 25 Feb 1864 at Budgarvitz, Bohemia, Europe. 4 children: Mary-age 16; Christina-age 13; Amalia-age 6 and Ernil-age 4. She complains that since marriage he has treated her in a cruel and inhuman manner, citing numerous incidents including causing miscarriages in 1872 and May 1881. She had to leave him on Oct 12, 1882 for safety after his treatment caused permanent injury to her body and the lose of use of her right hand. She is now unable to labor for her livelyhood and has to depend on the charity of friends. She had money before the marriage which he used to buy real estate. The court has ruled that he is in default of court ordered payments to her and he is to go to jail till he pays $10. The sheriff arrested hima nd put him in jail. She complains that since April 1882, he having a lucrative situation, has neglected and refused to provide for her and child. He is in the employ of Leathem and Smith of Sturgeon Bay. On Septer 23 last, she being informed by a clerk that he had not drawn a large amount of his wages, requested that her necessary household supplies be charged against his account and was informed by the bookkeeper of the firm and by John LEATHEM, a member of the firm that they had been notified by deft. that he would not pay for anything she might buy and has told several people that he will not pay for her bills. She was in delicate and feable health when married, which was still more impared by his treatment. Incidents of abuse are citaed. He is a habitual drunkard and on one occasion left her and children sick with diptheria at home while he was carousing around saloons and remained gone about a week and only returned home after one of the children was dead. He was quarrelsome and spent all substance of earnings in rioting and drinking. She complains that while she was ill and under medical care from March 15, 1882 to Oct 16, 1882, he didn't provide for or support her. They boarded at the same place, but he only paid for himself and she had to do housework and service for her board. She also cites other incidents. He charges that she and her parents are very strong 7th Day Adventists and he does not subscribe to their views and that her parents have been influencing her to leave him. She complains that after being married about 2 years, he began to abuse her and cites incidents. She left him Aug 1, 1883. He answers by denying all complaints and states that she has been very extravagant and has since their marriage foolishly and wantonly spent all of his surplus money, including his $1,200 pension from the US in ways not for the benefit of the family, and against his wishes as he wanted in invest that money in a house, but she would not allow him to do so. He also states that she has an ungovernable temper and has threatened his life, and other abusive acts are cited. He complains that she has associated with the lowest and worst people in the community and among others has allowed a disreputable negro named William DIXON to be in her company and repeatedly allowed him to take many indecent liberties with her, lsiting many incidents. She also kept company with A.N. RAMAGE, allowing him to take indecent liberties. When RAMAGE moved to Manitowoc, she followed him and continued her disgraceful conduct with him. When Deft. was gone from the city, at work on a steamboat, she and her mother took all the Deft's funiture to RAMAGE, moved from the house, and sold the furniture. He asks for custody fo the children as she in unfil. There is no judgement in this file. **** Sept 15, 1886 (file 887) SPEAR, Louise - vs - SPEAR, George O Married 1 June 1873 at the city of Green Bay, WI. 1 child - Clara Louisa - age 2 years. She complains that he left her on July 5, 1884, going to Ferry Village, Maine, that she was in poor health at a holtel when he left and that he paid for her board and lodging until Sept 1, 1884 after which time he refused to provide for her and child. She claims extreme cruelty towards her, that he left when she was in feeble health and had to care for a small child, that he left no money and sold all of their household goods. She also states that he caused malicious stories to be reported reflecting on her charity, that she has been deprived of every comfort and has applied to the city for her support. He answers, denying that he left her. In Aug 1884 he went to Maine, saying when he left, she was in her usual helath and borarding at the Exchange Hotel in Sturgeon Bay, that he had paid for the lodging and food for her and child until Oct 1884 and had made arrangements for their board and support at the hotel as long as they should stay there. But she left the hotel in Oct 1884 and took up residence at a dwelling in Sturgeon Bay that she thought belonged to him, but didn't, and she claimed it as a homestead. He has always supplied considerable money to provide reasonable demands and comfort during his absence and has offered a sufficient allowance where ever they might live. If she is supported by the city, it is unnecessary and without his knowledge, and that if she made such a request, it was to create a prejudice against him. She well knew that he was ready to furnish additional support upon her request to do so. She has not been kind to him, citing many incidents of her misconduct and her refusal to live with him. She is not fit to care for the child, and 3 different times a court has found her insane and sent her to the Northern Hospital for the insane. He is now in South America, under a physicians orders for his health. He has sent her lawyers suit money and alimoney for 2 months. He has caused a separate trial of lunacy to be held. Until his return, A.M. SPEAR of Cape Elizabeth, Cumberland Co, Maine will watch out for his interests. They had been living in Green Bay. In the fall of 1883 he moved to his farm in Town of Gardner, She refused to live with him when he requested her to accompany him. Since her refusal he has not visited or cohabitated with her, but did support the children. He charges her with adultery, because on March 10, 1885 she gave birth to a male child in Green Bay and it is not his child. He is awarded custody fo the oldest son and she is denied any rights to any of his property or equity in his property. On May 3, 1886 she eloped with Frenk BONISH, traveling as man and wife and now living together in Great Bend, Barton Co, Kansas. She has daughter Veroneka with her. Pltf. is granted sole custody of all chidlren. Deft. gets no alimony and forfeits all interest in Pltf's real estate in Town of Gardner, Door County, WI.
