Also Iowa County Mortgage Books, Vol. 5, Pages 382-384 Written: March 6, 1854 Recorded: September 20, 1859 “This indenture made the 6th day of March in the year of our Lord 1854, between GEORGE BUNTING and Mary Bunting, his wife, parties of the first part, and Norman Randall, party of the 2nd part, all of the county of Iowa and state of Wisconsin. Witnesseth that Witnesseth that the said party of the 1st part, for and inconsideration of sum of $850.00 to them in hand paid…hath sold…unto the party of 2nd part…the following tracts of land, situate and lying and being in the county of Iowa and state of Wisconsin…described as being the SW quarter of these quarter, and part of the NW quarter of the SE quarter of Section 30, town 6, range 3 East; and also the NW quarter of the NW quarter of Section 19, Town 6, Range 3 East of the 4th principal meridian, containing 85 acres, more or less…” “…Provided always, and these presents are upon this express condition, that if the said GEORGE BUNTING and Mary, his wife, party of the 1st part…shall well and truly pay…the sum of $850.00, one hundred and fifty dollars to be paid on the 1st day of January next; the remainder to be paid in four equal installments on the 1st day of January each year until the whole amount be paid, together with 7 % interest per annum…1855 according to the condition of a certain note bearing even date herewith executed by GEORGE BUNTING and Mary, his wife…as collateral security then, these presents and the said note shall cease and be null and void.” “And the said GEORGE BUNTING, and Mary, his wife, doth further covenant…that they will pay all taxes and assessments of every nature in pursuance of any law of the state for the sale of land for taxes, and also will pay the sum of $25 as solicitor’s fees in case of foreclosure of this mortgage by reason of the nonperformance of any of the conditions hereof by said party…” witnessed by Thomas James, William James [the Justice of the Peace], and Thomas Flint.” “To the court: In pursuance of an order of this court, made in the above entitled action, the __ day of September 1859 by which it was referred to the undersigned as a referee, to compute the amount due to the plaintiff on the note and mortgage mentioned in said complaint, I, George Frost, the referee in the said order named, do report, that I have computed and ascertained the amount due to the plaintiff upon and by virtue of the said note and mortgage, and that I find, and accordingly report, that there is due to the plaintiff for principal and interest on said note and mortgage, the sum of $553.45. And I do further certify that Schedule A, hereto annexed, shows a statement of the amounts due for principal and interest respectively, the period of computation of the interest and its rate. All, which is respectfully submitted. Geo. S. Frost, court commissioner and referee.
