The defendant is the principal action. JOHN POQUETTE was sworn and testifies as follows: “Am the defendant in the principal action in the case.” “Am acquainted with MATT REGAR.” “MATT REGAR was in my debt before the commencement of that action and at that time, Jan.26, 1885.” “It was for threshing for MATT REGAR.” “REGAR owed me forty-four 40/100 dollars at the time this action was begun. He is still in my debt that amount. My brother LEWIS POQUETTE and myself run a threshing machine. Each one had half of the money. My brother received more money than I did. My brother agrees with me that I should have his share with MATT REGAR, to make our accounts come out square.” “I never authorized REGAR to pay this money to anybody. I gave MATT instructions to keep the money and give it either to myself or my brother LOUIS. I never authorized GEO. JEUCK to make a demand upon MATT REGAR for the money, or to take it for me.” Cross Examination “The threshing for MATT REGAR is done some time in October, the first or second week. I told REGAR to keep the money for now or to pay to my brother, LOUIS, for me about the first of Jan. It was in Mr. GEO. JEUCK's store that I told him. LOUIS POQUETTE was present, and listening to our conversation. There was no one else present. I had asked REGAR to pay me the money SPENSLEY's road by (chance?) before I went out there on purpose. Nothing was said at that time about paying it to anybody else.” “Did not direct him in JEUCK's store to pay it to anybody else but my brother (?). My brother at that time had agreed that I should have his share of the bill. It was somewhere about the 1st of Jan. that I informed Mr. BLISS that REGAR owed me his money, and that I would pay him, that Mr. REGAR owed me some money. I can't tell whether it was before the money was paid Mr. JEUCK. JEUCK never told me that. I remember that he had received some money from REGAR. I did not have any conversation with JEUCK about his receiving any money from MATT REGAR. Mr. JEUCK never told me that he had received any money from MATT REGAR at any time. I first learned it after BLISS had (?) first garnished the money in MATT REGAR's hands. I learned it from Mr. BLISS in the street in front of his butcher shop. The papers had been served upon me as the principal defendant in the case at that time.” “I had been in the habit of trading at the JEUCK's and it was my principle trading place until about in July. I have done no trading there worth speaking of since July. Have been in there several times since. I have seen REGAR in there often, but not this winter.” Question; :Is it not a fact that in various occasions that Mr. JEUCK has received money for you from different parties and accounted to you for it?” Objected to. Objection withdrawn. Answer; “Yes, I suppose he has. I never objected to his receiving. I don't know whether he has given me credit for it or not.” Redirect “PETER REGAR had turned (?) in money to JEUCK for threshing this fall. Don't know of anyone else paying money to JEUCK for me except a transfer of an account which was Owed (?) to me. I was present at the time. I never gave Mr. JEUCK any ______ authority ________ account from _____ credit it on the books to me.” Recross “PETER REGAR told me about last of Dec. or 1st of Jan. that he had paid Mr. JEUCK some money for me. It was thirty ______dollars, was owing Mr. JEUCK the first of Jan. It was a store bill.” “LOUIS POQUETTE was sworn in on the part of the plaintiff.” “Am a resident of the town of Willow Springs, Lafayette Co.” “Am a farmer by occupation.” “I was present in JEUCK's store where the conversation took place between JOHN POQUETTE, MATT REGAR about the threshing bill.” “As near as I can recollect, JOHN asked him for the money, and he said he did not have it just then. Said he's shorted(?). __ __ ___ ___ he could get it and told him to hold it (?) until he saw him or me.” Cross Examination At that time the account had been ______to my brother. GEORGE JEUCK was sworn in on the part of garnishar. Know the parties in this action including MATT REGAR. “MATT REGAR paid some money to me for JOHN POQUETTE on the 5th day of Jan, 1885.” Question: “State what the conversation was with MATT REGAR as to his paying the money to you for JOHN POQUETTE.” Objected to. Objection withdrawn. Answer: “Mr. REGAR came to me and asked if I had seen the POQUETTE boys. He said he had some money to pay them and did not want them to come out after it again, and asked if it would be all right to leave the money with me. I told him it would be all right. he told me that his brother PETE left money with me also, and it had been all right. I offered him a receipt. REGAR said "Never mind that". I went to the books and gave POQUETTE brothers credit for it. They had a joint account with me. JOHN POQUETTE owed something near this amount paid.” “I saw JOHN POQUETTE on the 1st day of Jan. and told him that I had received that money MATT REGAR, and had given them credit for it and he said it was all right. I did not tell him the amount, the conversation was in our store. I said the PETE REGAR affair with LOUIS POQUETTE, two or three weeks before. The conversation on the first of January was about MATT REGAR's money. LOUIS told me that I could give them credit for the PETE REGAR money at the time we settled. Am positive about the date 1St of January being the date I (got?) MATT REGAR's money. My brother ARTHUR and WILLIAM RYAN being present when I told JOHNPOQUETTE about the money. They must have heard the conversation. I settled transaction with RYAN and POQUETTE in the same way and at the same time.” Cross Examination “PETER REGAR, in December, paid some money. It was along in the first week in January that I settled with LOUIS POQUETTE. I can't tell whether I saw JOHN POQUETTE between the time of settling this money of PETE REGAR (with his brother LOUIS) first week in January and the 17th January to have him talk him as far as I know JOHN POQUETTE knew nothing of the settlement with PETER REGAR and his brother up to the 17th of Jan. in the JEUCK's store. I was in the saloon when I informed JOHN POQUETTE that the MATT REGAR money was paid to me and I credited to them, and he said it was all right. I can't tell whether it was before or after this Mr. WM. RYAN account had been adjusted, it all occurred in about ten minutes. I did not tell JOHN POQUETTE how much money MATT REGAR had paid, neither did he ask me.” “I can testify plainly that I informed JOHN POQUETTE that this money from MATT REGAR was credited to them. Am positive that I said MATT REGAR paid and that I had given them credit for it and he said it was all right. LOUIS POQUETTE was not with him at that time.” MATT REGAR was sworn. “I live in the town of Linden. Am acquainted with JOHN POQUETTE and his brother LOUIS, and GEORGE JEUCK.” “POQUETTE brothers threshed for me in October. Their threshing amounted to Forty-four and eighty-nine cents. They came out to my house (I was in the field the latter part of December), to get the money, and said I did not have the money then, that I would pay it as soon as I could. LOUIS POQUETTE said that PETE REGAR left his money with GEO. JEUCK, and thought if PETE REGAR had so much money, he would come out and get paid too. I said I had a bull in fattening and when I sold, that he would get his money, and if you want the money before that, I must borrow it for you. LOUIS said never mind if you can't get it, other people have got to wait.” “Five weeks after that, I was coming to town for a funeral. I met JOHN POQUETTE by JAMES SPENSLEY's and I said, "Where are you going, JOHN?" He said, "I was going out to see you hoping(?) to get a little money. I said I have not got any as the bull (?) was young and not ready to sell (?). He said I wanted to go to JOHN ______, I said I would see you in town after the funeral. I came in on the first of January 1885, and I saw JOHN POQUETTE at Mr. JEUCK's. I said, I'm sorry (?) about the money. JOHN said I don't want to hurry anybody but as soon as you can get it you can give it to me or LOUIS, either. I said I shall pay you next week. I came in on Monday and went in to GEORGE JEUCK's, and asked if he had seen the POQUETTE boy-- He said no. I came in with my check to the bank, got the money, and went down to GEO. JEUCK's and I said I might as well leave that money for them boys today because I don't think I will be in again for this week. I said if I don't leave it here, they will be out again after it. I said you tell them as quick as you see them so they need not come out. to my farm (?) and asked Mr. GEO. JEUCK if it would be all right. He said yes and "I'll give the boys credit for it" and when I was going away, he said "Hold on, MATT, I'll give you a receipt for that money." I said, "never mind", and I had not taken it. There was not anything said about paying it to anyone else. JOHN said "keep it and give it to me or LOUIS". The reason I paid it to GEO. JEUCK was that I generally saw them in there. I supposed they would get quicker there than anywhere else that I know of.” WM. JEUCK was sworn. “Am a resident of the town of Mineral Point. Am acquainted with the parties in this action. Remember of JOHN POQUETTE being in our store on the 17th of January, 1885.” “GEORGE JEUCK said to JOHN POQUETTE that "MATT REGAR had left some money here for threshing you had done for him out there, and I'll give you credit for it", and he said "That is all right, GEORGE". GEORGE and JOHN POQUETTE, and a young fellow by the name of RYAN, was present at the time. I was about eight or ten feet from them when I heard the conversation. I did not hear PETE REGAR's name mentioned in the conversation. PETE REGAR left money with us for the POQUETTE boys on Dec.10th, 1884. GEORGE told me that he had told LOUIS POQUETTE of it. It was in _Jan'y that he told me that this money was credited them, that PETE REGAR had paid. GEORGE told me to give JOHN POQUETTE credit for four dollars that RYAN had paid. I was waiting for him (?) when sitting in the (back?) of the bar room to hear what JOHN POQUETTE would say about MATT REGAR's money paid him. The credit for four dollars from RYAN was after the MATT REGAR account. I did not hear any of the conversation about RYAN's account. GEORGE told me after they were in the store, I should think an hour.” Recalled. JOHN POQUETTE recalled. “The conversation which GEO. JEUCK testified to as having taken place in his store _____ to giving POQUETTE credit for the money paid JEUCK by MATT REGAR had been credited to them, and again having said "It is all right", is not true.” LOUIS POQUETTE recalled. “GEORGE JEUCK told me that he had given JOHN credit for PETE REGAR's money, he said that PETE REGAR had left his money there, and that he settled it with JOHN. I said I ______ it was all right. That was in December sometime.” Re-cross “It was sometime after that, about 1st January. JOHN said he did not know anything about it. That was all he said.” WM. RYAN was sworn on the part of the plaintiff. “Recollect being in JEUCK's store a week ago last Saturday, at the time I settled up with GEO. an account of four dollars, due POQUETTEs. Came out alone, JOHN POQUETTE went out first, they went all together in JEUCK's saloon. I can't say that where I was that I could hear all that was going on between GEORGE and POQUETTE. I went into the store from the saloon after my account was settled. Was not in the store more than two minutes. With that exception, was in the saloon all the time. Could hear the conversation between the boys. Never heard MATT REGAR's name mentioned. Whilst in there, think I was in there about three quarters of an hour.” Cross Examined “GEORGE JEUCK and JOHN POQUETTE were at the bar, when I went into the store. Was gone long time, enough to hear. GEO. JEUCK said to JOHN POQUETTE that he had given him credit for money him by MATT REGAR.” S. E. BLISS was sworn on the part of the garnishar and testified: “I learned that the money was first paid to Mr. JEUCK on Saturday last.
