George D. Rogers, former captain of Co. “G”, gave the following testimony: “In the spring and early summer of 1863, the 31st Rgt Wis. Vol. Infantry, in which I was captain at the time, of Co. “G”. Robert Tyrer, this claimant, was an enlisted soldier in Co. “H” of the same Reg’t. The regiment was stationed at Columbus, Kentucky. The claimant, Robert Tyrer came in from picket duty with other returned pickets, fired their guns under orders of the Colonel commanding said regiment onto the water of the Mississippi River.” “On the morning of the accident, as I heard at the time, the claimant on firing his gun, was hit in the eye by a piece of gun cap and that his eye was injured, but to what extent I do not remember, he not being a member of my Co. “G”. My knowledge comes from what I heard from other soldiers of the regiment at the time of the accident. I may have heard further particulars at that time, but cannot recall them now. I have seen the claimant but once since the regiment was mustered out of the service and then the eye appeared totally blind and is due to said accident, as I fully believe.” The following testimony was given by Freeman R. Pease: “I was second sergeant of Co. “H” 31 of Wis. Vol. Inf. And was personally and well acquainted with the claimant Robert Tyrer, a member of said Co. and Regt during the Civil War.” “I remember distinctly and well that on or about June 1st, 1863 at Columbus, Kentucky, that the claimant was with a detail of men returning from picket duty and the detail was ordered to discharge their guns, an in doing so a piece of the cap off of the claimant’s gun struck the claimant in the right eye.” “I know of the above from personal knowledge as I was present at the time and place stated and tried to get the piece out of the claimant’s eye.” Robert Tyrer gave the following testimony: “After the accident to the right eye the vision entirely failed inside of thirty days. On the morning after the accident the piece of cap was extracted by Sergeant Freeman R. Pease, and the dressing of the eye was done by Edward S. Eddy, Hospital Steward-now deceased, and the next day a furlough for thirty days was granted, and during my stay at home the eye was dressed by Doctor Burrell of Dodgeville Wisconsin, also now deceased, and in September of 1865 I had the eye operated upon by a specialist at Chicago, Doctor W. T.
