The petition of Louise Koeppen the Town of Grant, Shawano County Wis. by M.J. Wallrich, her attorney, respectfully shows to this Court:- I. That William Koeppen, died at his home in the Town of Grant, Shawano County Wis. On the 21st day of Nov. A.D. 1891 seized of estate of inheritance in real estate hereinafter described and leaving no personal property in this State which would be proper assets in the hands of an administrator for the payment of debts. That more than six months have elapsed since the death of the said William Koeppen, that his last place of abode was in the Town of Grant, Shawano County Wis. II. That he left surviving him Louisa Koeppen, his widow, Louisa Bergeman nee Koeppen whose residence is at Letshin bei Writzen on Oder in Prussia, Europe, Augusta Welsch of Leopolis, Wis., August Koeppen of Eagle River, Wis, and Albertine Genskow of Marion, Wis, and William Koeppen of Pella, Wis., his children who are of age and under no disability.- III. That the land of which the said William Koeppen died seized is described as follows: The east half of the south- east quarter of section Number thirty-six (36) in Township number Twenty-six (26) North, of Range Number thirteen (13) East... Wherefore your petitioner prays that a time be fixed for the hearing of the said petition and that the court determine and decree by judgment who are the heirs of the said William Koeppen and what interest if any said heirs are entitled to in the above described lands. Loisa (sic) Koeppen being duly sworn on oath says that she is the petitioner above named; that she has heard read the above and foregoing petition and knows the contents thereof and that the same is true to her own knowledge except as to those matters therein stated to be on information and belief and as to those matters she believes it to be true. County Court State -- Shawano County: In Probate In the matter of the estate of William Koeppen, deceased. --On reading and filing the petition of Louisa Koeppen duly verified, wherein it is alleged; that on the 21st day of Nov. 1891, at the town of Grant in said county William Koeppen died intestate leaving real estate within the County of Shawano and State of Wisconsin, at his last and legal place of residence at the time of the death of said deceased, being in said town, county and state aforesaid; that said deceased died seized and possessed of certain real estate known and described as The East half of the South-east quarter of Section Number thirty- six (36) in Township number Twenty-six (26) North, of Range Number thirteen (13) East in the County of Shawano and State of Wisconsin That said petitioner is the widow of said deceased. – That the said left deceased left surviving him as his heirs at law: Louisa Koeppen, his widow, Louisa Bergeman nee Koeppen whose residence is at Letshin bei Writzen on der Oder in Prussia, Europe, Augusta Welsch of Leopolis, Wis., August Koeppen of Eagle River, Wis, Albertine Genskow of Marion, Wis, and William Koeppen of Pella, Wis., his children who are of age and under no disability.-That the deceased left no personal property in this state which would be proper assets in the hands of an administrator. – That deceased left no debts due and unpaid, - And praying, that the court fix a time and place for hearing said petition, and the proofs in relation thereto, and that due notice be given of said hearing according to law; and from the evidence produced upon said hearing the Court by its judgment determine the decent of the real estate aforesaid, and decree and adjudge that: Louisa Koeppen widow said deceased. Louisa Bergeman nee Koeppen, Augusta Welsch, August Koeppen, Albertine Genskow and William Koeppen are sole heirs at law of said deceased and entitled to all the right title and interest of said deceased in and to the said real estate. – It is ordered that said petition be heard by this court at a special term thereof to be held at the Court House in the City of Shawano in the County of Shawano, State of Wisconsin, commencing at 10 o'clock A.M. of the 28th day of June A.D. 1892— ORDERED FURTHER that notice of said hearing be given to all parties interested in said estate by publication of said notice for three successive weeks prior to said day of hearing in the "Shawano County Journal" a weekly newspaper, published and printed in the city of Shawano in said county, and such other notice as is required by law to be given to the parties interested in the estate. -Dated at the city of Shawano, Wis, this 3" day of May, 1892.- By the Court H. Naber County Judge State of Wisconsin, County Court, Shawano County, In Probate. - In the matter of the estate of Friedrick William Koeppen, late of this County, deceased Notice is hereby given, that at a special term of said County Court to be held in and for said County at the Court House in the City of Shawano, in said county, commencing at 10 o'clock, A.M. of the 28th day of June A.D. 1892. Naber William Koeppen, Deceased. } June 28th 1892 August Koeppen sworn I live at Eagle River Wisconsin I have received notice of the hearing of today. I object to the hearing of today. I withdraw objection. I knew Wm. Koeppen of the Town of Grant Shawano County. He was my father. He died about the 21st day of November 1891. he left property, 80 acres of land described as the east half of the south-east quarter of section Number thirty-six (36) in Township number Twenty-six (26) North, of Range Number thirteen (13) East. I owned this land once. I had a good title to the land. I deeded this land to Wm. Koeppen. I gave a warranty deed to Wm. Koeppen. Aug. Koeppen Wm. Koeppen of the Town of Pella sworn I live in the Town of Pella I knew Wm. Koeppen of the Town of Grant. He is my father. He died on the 21st day of November 1891. Do not know of his making a will. He left his widow and five children all over the age of 21 years. Louise Koeppen is the widow resides in Grant. Wm. Koeppen resides in Pella. Louise Bergeman nee Koeppen residing at Letchin in Prussia. Auguste Welsch nee Koeppen residing in Leopolis Town. Herman and August Koeppen residing at Eagle River Wisconsin. Albertine Genskow residing at Marion, Waupaca Co. Wis. He left no other children. He left property 80 acres of land as described by preceding witness. He left personal property of the value of about $200.00. There is a warranty of August Koeppen to Wm. Koeppen Deceased on record. Wm. Koeppen John Genskow sworn I live in the Town of DuPont Waupaca Co. Wis. I knew Wm. Koeppen during his lifetime I know when he died. He died on the 21st day of November 1891. He died at his residence in the Town of Grant, Shawano county Wisconsin. The description of his land in the preceding testimony was correct. John Genskow Wm. Koeppen recalled Louise Koeppen the widow of Wm. Koeppen deceased lives on the east half of the south-east quarter of section Number thirty- six (36) in Township number Twenty-six (26) North, of Range Number thirteen (13) East. That is her homestead. Wm. Koeppen deceased had no other legal residence, than his house in Town of Grant where he died. He owed no debts at the time of his death. His estate has not been administered. Wm. Koeppen State of Wisconsin, County Court, Shawano County, In Probate. - In the matter of the estate of Friedrick William Koeppen, late of this County, deceased, intestate. Present and Presiding, Hon. H. Naber, County Judge The application of Louisa Koeppen by verified petition for a judgment of this court, which shall determine who are the heirs at law of William Koeppen late of the Town of Grant, in said county, deceased intestate and of what lands said deceased died seized and possessed, and what is the share and interest of each of said heirs in and to the said land and in and to the title of said deceased thereto, having duly come on to be heard by the court at the term thereof above designated, pursuant to the order of this court in the above entitled matter, dated 3"day of May 1892, and said petitioner having duly appeared by M.J. Wallrich her attorney, and said petitioner having duly appeared in said matter this day before the Court by M.J. Wallrich, her attorney, and due proof of the publication of the notice of said hearing required by said order aforesaid, having been made and filed by the affidavit of J.R. Gorham … of the "Shawano County Journal," of Shawano Wisconsin. And notice of said hearing having been duly served on Louise Bergeman nee Koeppen, heir at law of said deceased whose residence is outside of this State, by mailing a copy thereof together with a copy of said petition to her place of residence. And Carl August Koeppen heir at law of said deceased and above the age of Twenty-one, and of no disability, having duly appeared at said hearing and consented thereto, and Augusta Welsch, Albertine Genskow and William Koeppen, heirs at law of said deceased over the age of Twenty- one, and of no disability having duly appeared at said hearing and consented thereto. And said petitioner having offered in evidenced documentary proof of the title of said deceased in and to the lands described in said petition, and such proof having been received, -And the court having duly considered all the evidence in the matter, and it appearing satisfactory that the allegation of said petitioner are true, and that the prayer thereof ought to be granted. Now therefore on motion of M.J. Wallrich, Att'y for said petitioner, The Court Finds: I- That on the 21" day of Nov. 1891, at the Town of Grant, in said County, the said William Koeppen died intestate, and that his last and only legal residence was in said town at the time of his death. II- That said deceased left surviving him his widow, Louise Koeppen and his children and heirs at law; Louise Bergeman, Augusta Welsch, Carl August Koeppen, Albertine Genskow and William Koeppen all of whom are now living; and that he left no other children and heirs at law than those above named. III That there is no indebtedness of said deceased unpaid, and that his estate has not been administered. IV—That said deceased left no personal property in this state. V-- That said deceased died seized and possessed of certain real estate situate in the county of Shawano and state of Wisconsin and known and described as: The east half of the south-east quarter of section Number thirty- six (36) in Township number Twenty-six (26) North, of Range Number thirteen (13) East. And that no conveyances have been made since the death of said deceased. And as a conclusion of law from the foregoing findings the Court holds that the children of said deceased, namely: Louise Bergeman, Augusta Welsch, Carl August Koeppen, Albertine Genskow and William Koeppen are the sole and only heirs at law of said deceased, and that each of said children succeed to and is now seized of and entitled to an undivided one fifth share and interest in the lands above described, subject however to the rights by courtesy of said Louise Koeppen, as widow of said deceased, in and to such lands. Wherefore the court does hereby adjudge, that said Friedrick William Koeppen, deceased intestate, died seized and possessed of the land above described. That Louise Bergeman, Augusta Welsch, Carl August Koeppen, Albertine Genskow and William Koeppen are sole and only heirs at law of said deceased, and as such are entitled to an undivided one fifth right, share and interest in and to the lands above described, subject however to the rights by courtesy of said Louise Koeppen as widow of said deceased, in and to such lands.
