Ebneter, , January, 1999 ************************************************************************** Deed Book 21, Page 552 This indenture made this 16th day of December in the year of our Lord one thousand eight hundred and nine between Martin Houseman and Elisabeth his wife of the County of Berkeley and State of Virginia of the one part and Peter Custer of the County and State aforesaid of the other part. Witnesseth that for and in consideration of the sum of fourteen dollars current money of the United States to the said Martin Houseman and Elizabeth his wife in hand paid by the said Peter Custer at or before the sealing and delivery of these presents, the receipt whereof he doth hereby acknowledge and thereof doth release, acquit, and discharge the said Peter Custer his executors and administrators by these presents they the said Martin Houseman and Elizabeth his wife have granted, bargained, and sold and by these presents do grant, bargain, and sell unto the said Peter Custer and his heirs a certain lot of land situated, lying and being in the said County of Berkeley and State aforesaid it being part of a larger tract of land which was conveyed to the said Martin Houseman by Valentine Knup and his wife by their certain indenture bearing date the date the __ day of April in the year of our Lord one thousand eight hundred and seven and recorded in Berkeley County office and being the same lot of land which was leased to the said Peter Custer by Valentine Knup during the said Peter Custer and his wife's natural life and sold by the said Knup to the said Houseman under the circustances of said lease and bounded as follows viz: Beginning at a stake on the South side of the Great Road leading to Rosenbergers Mill thence N 71 1/2 W 13.9 poles to a stone thence S 37 E 19 to a stake thence N 9 E 11 poles to the beginning and all houses, buildings, orchards, ways, waters, water courses, profits, commodities, hereditaments, and appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof, and also all the estate, right, title, interest, use, trust, property, claim, and demand whatsoever of them the said Martin Houseman and Elizabeth his wife of in and to the said premises, and all deeds, evidences, and writings touching or in any wise concerning the same. To have and to hold the lands hereby conveyed and all and singular other the premises hereby granted and every part and parcel thereof with their and every of their appurtenamces unto the said Peter Custer his heirs and assigns forever, to the only proper use and behoof of him the said Peter Custer his heirs and assigns forever and the said Martin Houseman and Elizabeth his wife for themselves their heirs, executers, and administrators, doth covenant, promise, and grant to and with the said Peter his heirs and assigns by these presents that the said Martin Houseman and Elisabeth his wife now at the time of sealing and delivering of these presents are seized of a good, sure, perfect, and indefeasible estate of inheritance in fee simple of and in the premises hereby granted and that they have good power and lawful and absolute authority to grant and convey the same to the said Peter Custer in manner and form aforesaid and that the said premises now and forever hereafter shall remain and be free and clear of and from all former and other gifts, grants, bargains, sales, dower, right, and title of dower judgements, executions, titles, troubles, charges and incumbrances whatsover made, done, committed, or suffered by the said Martin Houseman and Elizabeth his wife or any person or persons whatsoever (the land tax imposed by law only excepted and foreprized) And lastly that the said Martin Houseman and Elizabeth his wife and their heirs all and singular the premises hereby granted and released, with the appurtenances, unto the said Peter Custer and his heirs and assigns against them the said Martin Houseman and Elizabeth his wife and their heirs and all and every other person and persons whatsoever shall warrant and forever defend by these presents in witness whereof the said Martin Houseman and Elizabeth his wife hath hereunto set their hands and seals the day and year above written.Signed Sealed and delivered In presence of his Martin X Houseman mark (LS)Lewis Lewis Jacob Custer his John X Marchant mark her Elizabeth X Houseman(LS) mark
