Deed - Benjamin Foster The following record has been donated to the Brooke County, WVGenWeb archives by Sandy Onbey Oct. 1998 It may be freely copied, but should not be copied for commercial gain. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Transcribed from Brooke County Virginia Deed Book 3, Page 354 Whereas Benjamin Foster and William Storer are possessed of a certain tract of land Con- taining two hundred and forty eight acres in the County of Brooke and State of Virginia, which they jointly purchased from John Van Buskirk & Betsy his wife as by deed of conveyance for the same dated the fith day of September in the year of our Lord one thousand seven hundred and ninety six remaining on record in the Clerks office of the County Ohio & State aforesaid, re- ference being thereunto had will more fully and at large appear. This Indenture therefore Witnesseth that the above named William Storer and Sarah his wife for and in consideration of the sum of eight hundred and six dollars to them in hand well & truly paid by the above named Benjamin Foster the receipt whereof they do hereby acknowledge and themselves therewith fully satisfied and paid have granted, bargained, and sold, and by these presents do grant, bargain, and sell, enfeoff, release, convey and confirm unto the said Benjamin Foster and to his heirs and assigns forever, all their right, title, interest property claim and demand whatsoever of and to the tract or piece of land above mentioned and bounded as follows Viz Beginning at a Iron wood in a run in a line of the Original and with the same North three degrees West sixty two poles to a sugar tree, thence North twelve degrees 75/100 West one hundred and seventy seven poles & eight tenths of a pole to an ash near a run, thence down said run with the Mean- ders thereof and binding thereon two hundred and twenty one poles to an elm on the River Bank thence South twentyu one degrees and an half, East one hundred and sixty four poles to a dog- wood, Beech & Hickory, thence South five degrees East one hundred and twelve poles to a linn and Beech on a run thence leaving the original and up said run with the meanders thereof & binding thereon one hundred and sixty four poles to the beginning. Containing as above men- tioned two hundred and forthy eight acres, the above described land is situated on the waters of the Ohio River in the County of Brooke and State of Virginia, and is part of a tract of four hundred and ninety four acres that was granted by Beverly Randolph Esquire Governor of Virginia to Laurance Van Buskirk on the 2nd July A. D. 1787, who conveyed to John Van Buskirk above mentioned, to have and to hold the above described two hundred and forty eight acres of land, with the appurtenances to the above named Benjamin Foster his heirs and assigns forever, and the above named William Storer and Sarah his wife as joint tenants with the said Benjamin Foster for the said land do hereby covenant & agree that they the said William and Sarah, shall and will warrant and forever defend to the said Benjamin his heirs and assigns the one equal half of the above described two hundred & forty eight acres of land with the appurtenances against the lawfull claim of all persons whatsoever.
