Deed - Foster/Taylor Deed - Benjamin Foster The following record has been donated to the Brooke County, WVGenWeb archives by Sandy Onbey Oct. 1998 It may be freely copied, but should not be copied for commercial gain. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Transcription of deed recorded in Deed Book 9, pp 512 & 513 at Coshocton County, Ohio This Indenture made this Twenty fifth day of June in the year of our Lord 1832 between Ebenezer Taylor and Margaret his wife of the County of Cosh octon in the state of Ohio of the one part and Benjamin Foster of the County of Brooke in the State of Virginia of the other part Witnesseth that the said Ebenezer Taylor & Margaret his wife for and in consideration of the sum of five Dollars to them in hand paid at and before the sealing and deliv ery of these presents the receipt whereof is hereby acknowledged have grant= ed bargained and sold and by these presents do grant bargain sell convey and confirm unto the said Benjamin Foster his heirs and assign all the interest right title claim and demand at law & equity of them the said Ebenezer and Margaret his wife or either of them of in and to a certain Tract or parcel of land situate in the County of Brooke aforesaid and containing 244 acres more or less being the same Tract or parcel of Land on which Benjamin Foster Sen late of the said County of Brooke deceased resided and of which he died seized and which by the death and intestacy of the said Benjamin Foster senior descended to his heirs at Law of whom the said Margaret is one. To have and to hold the same and all the interest claim and demand of them the said Ebenezer Taylor and Margaret his wife therein to him the said Benjamin Foster--his heirs and assigns forever to the only proper use and behoof of him the said Benjamin Foster his heirs and assigns forever And the said Ebenezer Taylor & Ma rgaret his wife for themselves their heirs Exrs and admins do hereby covenant to a**d with the said Benjamin Foster his heirs and assigns that they the Tract or parcel of land aforesaid to him the said Benjamin Foster his heirs and assigns shall and will by these presents forever warrant and defend against themselves and each of them their and each of their heirs and against all persons claiming or to claim the same by or under them or either of them but against no other person or persons whatsoever In testimony whereof they the said Ebenezer & Margaret his wife have hereunto set their hands & affixed their seals the day and year first above written Signed Sealed in the presence of Ebenezer Taylor (Seal) F. Stafford and Bradly Squires Justices of the peace in The County aforesaid in the State of Ohio do hereby certify that Ebenezer Taylor & Margaret his wife parties to the foregoing convey= ance personally appeared before us in our said County and acknowledged the same to be their and --deed and desired us to certify their said ack= knowledgement to the Clerk of the County Court of Brook in the state of Vir= ginia in order that the said deed may be recorded And the said Margaret wife of the said Ebenezer Taylor being by us examined privilly and apart from her husband and having the said deed fully explained to her declared that she had willingly signed Sealed and delivered the same and that she wished not to retract it.
