July 12, 1998 Deed from Benjamin Foster Benjamin Foster to Ebenezer Taylor This indenture made and entered into this Eleventh day of January in the Year of our LORD one thousand Eight hundred and Seventeen by and between Benjamin Foster of Brooke County Virginia of the one part and Ebenezer Taylor of Jefferson County in the State of OHIO of the other part Witnesseth that the said Benjamin Foster, as well for & in consideration of the natural Love & affection which he bears towards the said Ebenezer Taylor & Margaret his a daughter of him the said Benjamin and towards the children of said Ebenezer & Margaret now upon the body of the said Margaret in Lawful wedlock begotten or hereafter to be begotten - as also for and in consideration of the sum of Two dollars to the said Benjamin by the said Ebenezer hand paid the receipt whereof is hereby acknowledged the said Benjamin for himself & his heirs Executors & administrator doth grant bargain sell convey and confirm unto the said Ebenezer Taylor all the following described tract of Land and premises with the appurtenances-Situate lying & being in the county of Coshocton & State of OHIO adjoining the Military lands of Robt McLaughlin and others, on the waters of *appatinechy Creek & for which said Land said Benjamin Foster procured a patent from the United States bearing date the 11th day of October 1814 & now Lying in the Land's Office at Zanesville OHIO Reference thereto bring hand will mercifully and at large appear To Have and to Hold the above described tract of LAND & promises to the said Ebenezer Taylor during his natural life subject to impeachment or Forfeiture for waste & for & after the determination of the said Estate for Life the said parcel of Land & premises to be and remains to the use and benefit of the before mentioned named Margaret wife of the afd Ebenezer during her natural life for the support and maintenance & that of her children so as aforesaid begotten or hereafter to be begotten as aforesaid should She the said Margaret survive the said Ebenezer- and that upon the determination of the Estate first mentioned the said Margaret to have her election either to have her dower or one third of said Lands, assigned her or retain the whole lands during her natural life aforesaid subject to the support of the children aforesaid - and that from & after the determination of both the estates so as aforesaid described the said Land and premises to descend to the sons & daughters of the said Ebenezer and Margaret so as aforesaid begotten or hereafter to begotten in first & equal proportions their heirs and assigns forever\ to be divided according to quality quantity & the relative value of the Whole Lands, such partition to be made immediately upon the death of the aforesaid Ebenezer & that of his wife & that the said sons and daughters shall severally receive their shares as they respectively arrive (at) the age of twenty one Years and that if the said heirs or their guardians cannot agree as to the division then they are to draw Lots for their respective shares___ To Have and to Hold the same to them & their heirs & assigns forever & should any of the aforesaid heirs die between the determination of the two Estates aforesaid and the making of partition of the Estate aforesaid then such partition to be made in equal proportion among the surviving heirs of the said Ebenezer Taylor & Margaret his wife so as aforesaid\ In witness where of the aforesaid Benjamin Foster hath hereunto set his hand and affixed his seal the day and year first above written Benjamin Foster Witness: John Cox Samuel Herdman L Connell The above conveyed premises is the south East quarter of section No. 2 of township No. 4 of Range No. 8 of the Military district of lands directed to be sold at Zanesville Recorders Office Coshocton County OHIO___This Deed was filed in my office for the Record March **18** and was Recorded 13th of same Month and Year in Book No. 7 Page 355 Jas.
