Lee mahan and Frances Mahan, his wife, Walter E. Mahan and Audrey Mahan, his wife, hereinafter known as the GRANTORS, to John Geary and Sarah Geary, hsi wife, herinafter known as the GRANTEES, all of the County of Brooke and State of West Virginia,WITNESSETH, that for and in consideration of the sum of Ten ($10.00) Dollars, the receipt whereof is hereby acknowledged and for other good and valualbe consideration, the said GRANTORS do hereby grant and convey unto the said GRANTEES, all that certain lot of parcel of land situate in Cross Creek District, County of Brooke and State of West Virginia in a plan of lotslaid out by H.B. Mahan, east of the city of Follansbee, known as "SPRINGDALE" on which the said parcel of land herein conveyed is designated by Lot Number 237 as shown by map drawn by M.E. Boyd, C.E., under the date of July 10, 1924; subject however to the following restrictions and reservations,viz: (1) No building or buildings, nor structure or structures whtever, shall be placed nearer than fifteen feet to roads and streets, as shown on said plan. (2) GRANTORS reserve to themselves, their succesors and assigns, all the coal and other minerals underlying the land as shown in said plat, together with the right to mine and remove the same, and the right to convey under said land the coal and other minerals from other lands. But in so mining and removing said coal and other minerals as aforesaid, and the conveying of coal and other minerals under said land, no damage whatsoever shall be done to the surface of said lot as shown herein. (3)The said GRANTORS reseve to themselves, their successors and assigns, the fee in all streets, alleys and public ways adjoining said lot and the right to grant all franchises whatsoever, alson, on ,under, over and across the same, granting to the purchasers of the said lot onlu the right of ingress, egress and regress along, on , over and across said street, alleys and public ways as shown on said "SPRINGDALE PLAN of LOTS". (4) This conveyance is made subject to the right of way of the Telephone Company as it now exists. (5) This lot shall never in any manner be rented, leases ot sold to any person not of the caucasian race. The said GRANTORS herby covenant to warrant generallythe property hereby conveyed except at to the above restrictions and reservations.
