It may be freely copied, but may not be sold. ******************************************************************* Last Will and Testament of Andrew Fout June 13, 1808 In the name of God Amen I Andrew Fout of Brooke County and State of Virginia considering the uncertainty of this mortal life and that it is appointed for all men once to die being in a low state of health but of sound mind and memory blessed be God for his mercies, do make and constitute this to be my last Will and Testament in the manner and form following, to wit Item / I do give and bequeath unto my well beloved wife Ann Fout the plantation wherein I now live with the sugar camp on the side of the hill, known by the name of Spring run place, and with a strait line to intersect the road leading from West Liberty to Wm. Beard (s), during her widowhood. Item / I do give and bequesth unto my beloved wife Ann Fout two work horses and one bay yearling calf and faming utensils sufficient ______ the said plantation with. Item / I do give and bequesth unto my well beloved wife Ann Fout four milch cows, which she whall choose out of the stock to be at her own disposal with all the furniture of the house. Item / I do gie and bequeath to my sons David Fout, Lemen Fout, Andrew Fout, Allen Fout, Jacob Fout, William Fout, Absalom Fout and Sebastian Eaty Fout, and my daughters Memima Fout, Ann Talbot, Mary Fout and Sarah Fout the remainder part of my real property to be sold and equally divided between them, Item / I do give and bequeath unto my son Jacob Fout the black stud horse. Item / I do give and bequeath unto Jemima Fout one sorrel mare which is now called hers. Item / I do give and bequeath unto John Springer one hundred dollars. Item / I do give and bequeath unto Jane Springer fifty dollars. Item / and as to the remainder of my personal property it is to be sold at public sale and after the legatees and my debts is paid the remainder is to be divided equally between the above named twelve children and if there is not sufficient to pay the legatees and discharge the debts it is to be paid out of the sale of the land. Item / I do hereby appoint William _____, W. Hinley and Andrew Fout to be the sole executors of this my last Will and Testament. Item / I do hereby revoke and disannul any former Will or Wills by me made at any time whatsoever, and I do declare this to be my last Will and Testament in witness hereof I have herunto set my hand and affixed my seal this thirteenth day of June one thousand eight hundred and eight.
