Written - 08 Jul 1852, Probate - 27 Mar 1854 Book 2, Page 154 - Cabell County, WV Courthouse Know all men by these present that I Philip Baumgardner of the County of Cabell and state of Virginia do make my last and testament in manner following towit 1st It is my will and desire that all my just debts & funeral expense be paid out of my estate by my exectors herein after named 2nd It is my will and desire that my exectors do pay to my wife after my death the money & property as agreed between us in a written contract now of record in the clerks office of Cabell county court 3rd It is my will and desire that all the rest of my estate be divided as following 4th To the child my last wife had since we were married the sum of two dollars. And to Mary (or Polly) James John Hettie Deborah Emerine William Joanah & Louisa the children of my first wife I give and bequeth the balance of my estate to be devided share and share alike 5th It if shall appear that I have any right by will to convey an interest of my wife in the estate of her father late of Augusta county Virginia then I give all such right to the child (without name) had by my wife since our Marrage I hereby appoint my son John Baumgardner and William Merritt my son in law exectors of this my last will and testament revoking annulling all other wills by me heretofore made In witness whereof I have hereunto set my hand & seal this 8th day of July 1852 attest Philip Baumgardner (seal) Greenvill Harrison Christian S. Miller Virginia Cabell County Court March 27th 1854 The last will and testament of Philip Baumgardner (dec) was this day presented in court and was proved by the oath of Greenvill Harrison and Christian S.
