B., 78th Pennsylvania Regt. Infantry volunteers in the War of the Rebellion and served at least ninety days, and was Honorably Discharged at Nashville, Tennessee on the 11th day of September, 1865. That he is partially unable to earn a support by reason of rheumatism. That said disabilities are not due to vicious habits, and are to be best of his knowledge and belief permanent. That he has not applied for pension under application No._____. That he is not a pensioner under Certificate No.______. That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of June 27, 1890. He hereby appoints J.B. Cralle & Co., U.S. Pension Attorneys, Cralle Building, 108 C Street, Northwest, Washington, C.D., his true and lawful attorneys to prosecute his claim; and he hereby agrees to allow said attorneys the lawful fee of Ten Dollars for their services when his pension is allowed. Samples (Second Witness) (2) Act of June 27, 1890 DECLARATION FOR WIDOW'S PENSION State of West Virginia County of Clay "On this 4th day of March, A.D. one thousand eight hundred and ninety-five personally appeared before me, a notary public within and for the County and State aforesaid, Mary M. Procious, aged 40 years, who being duly sworn according to law, declares that she is the widow of Adam Procious, who enlisted under the name Adam Procious at ______ on the 29th day of February, A.D. 1864, in Company B 78 Regt., Pennsylvania Infantry and served at least ninety days in the late war of the Rebellion, and who was honorably discharged on the 11th day of September 1865, and died on the 30th day of January, 1895 at Procious, Clay County, WVa. That she was married under the name of Mary M. Paxton to said Adam Procious on the _____day of June, 1879, by S.B.Grose at (unintelligible), there being no legal barrier to said marriage. Said Adam Procious had formerly been married and marriage was dissolved by death of first wife. That she has not remarried since the death of said Adam Procious. That she is without other means of support than her daily labor. The names and dates of birth of all the children now living under sixteen years of age of the soldier by herself are as follows: Donna Procious, born Dec. 12, 1883 Vernilla Procious, born September 17, 1885, Daisy Procious, born Sept. 24, 1886 Minnie Dahlia Procious, born January 21, 1889 Lola Hester Procious, born March 12, 1891 There is a discrepancy in the marriage date in the above Declaration and the Minister' s statement. The above states the marriage took place in June, 1879, and Rev. Grose writes the date May 29, 1879. (3) GENERAL AFFIDAVIT State of West Virginia, County of Clay "In the matter of Mary M., wid. of Adam Procious......in Co. "B" or the 78" Reg't of Pa. Inft.Vols., for Widow's Pension. On this 25 day of March, A.D. 1895 personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths, Wm. P. Walker, aged 67 years, a resident of Dismal, in the County of Kanawha and state of WVa, whose Post Office is Dismal and well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: That he has known the claimant Mary M. Procious, "widow of Adam Procious, deceased soldier and my acquaintance with her for about 24 years , know that she was not married prior nor since her marriage to the said soldier Adam Procious and that said Adam Procious' former wife, to which he was married before his marriage to the said Mary M. Procious is dead...that I saw her die which occurred August, 1878, and that I have attended as physician at the time of the birth of four of said soldier's children which dates were as follows: Donna Procious, born Dec. 12, 1883 Vernilla Procious, born September 17, 1885, Daisy Procious, born Sept. 24, 1886 Lola Hester Procious, born March 12, 1891 and further that said Mary Procious, widow of Adam Procious is without any means of support other than her daily labor.
