Submitted 1998 by Patt Seitas ************************************************************************** GILMER COUNTY, WV DEED BOOK 2, P. 195: Hezekiah & Mary Stout to John Marks This Indenture made and entered into the twenty fourth day of January 1852 Between Hezekiah Stout and Mary his wife of the County of Gilmer and State of Virginia of the one part and John Marks of the same county and State aforesaid of the other part. Witnesseth that the said Hezekiah Stout and Mary his wife for and in consideration of the sum Two Hundred Dollars current money of __(?) in aforesaid State to them in hand paid by the said John Marks at and before the ensealing and delivery of these presents The receipt whereof the said Hezekiah Stout and Mary his wife doth hereby acknowledge. He the said Hezekiah Stout and Mary his wife hath granted bargained and sold aliened [sic] and confirmed and by these presents doth grant bargain and sell alien and confirm unto the said John Marks his heirs and assigns all that m___ge(?) and all that Tract peace [sic] or parcel of Land Situate lying and being in the County aforesaid on the had of Little Bull Run and is Bounded as followeth Viz Begining [sic] at a Poplar Tree Standing neer [sic] the head of said Run about twenty poles below a placed called the old camping place and Running thence South Sixteen East Eighty poles to a Black Gun and Beech thence North thirty one East Eighty four poles to a Beech and Shugar [sic] then North Eight-two East one Hundred and Two poles to a Forked Poplar then North Eight West Sixty Two poles crossing the Run to a White Oak thence South Sixty-Six West 173 poles to the beginning to contain fifty acres more or less and also all trees wood and under wood titles(?) commons common of pasture prophets [sic] commodities advantages herediments ways waters and appertenances [sic] to the said Breess__? and Land above mentioned belonging or any wise appertaining and also the reversion and reversions Remainder and Remainders Rents and servise [sic] of the said premises and of every part thareof [sic] and all the Estate right title Interest claime [sic] and demand whatsoever of therein the said Hezekiah Stout and Mary his wife of in and to the said Messuage and premises and evry [sic] part thereof have and to hold the said Massuage or tenement and all and singular the premises above mentioned and evry [sic] part and parsol [sic] thereof with the appertainances [sic] unto the said John Marks his heirs and assigns to the only proper use and School(?) of the said John Mark his heirs and assigns forever and the said Hezekiah Stout and Mary his wife for themselves are there [sic] heirs the said Messauge or tenements to promise and against evry [sic] part thareof [sic] and against them and there [sic] heirs and against all and evry [sic] other person or person claiming by from or under them or any of them to the said John Marks his heirs and assigns shall and will warrant and forever defend by these presence [sic] In witness whareof [sic] the said Hezekiah Stout and Mary his wife have hereunto set their hands and affixed there [sic] seals. Hezekiah Stout (seal) Mary Stout (seal) Gilmer County Court Personly [sic] appeared before me C.B. Conrad in my county a Justice of the peace in and for Gilmer County Hezekiah Stout party to a certain Deed bearing the 24th day of January 1852 and hirto [sic] annexed and acknowledged the same to be his act and deed. Give under my hand and Seal this 24 day of January 1852. C.B. Conrad (seal) Gilmer County Court Personally appeared before us in our County C.B. Conrad & Elias Varner Justices of the peace in and for said County Mary Stout wife of Hezekiah Stout seizor party to a certain Deed bearing date the 24th day of January 1852 and hereunto annexed and acknowledged the same to be her act and Deed and wished us to certify her said acknowledgement to the Clerk of the County Court of Gilmer County that the same might be recorded the said Mary Stout being by us examined privately and apart from her husband after said Deed being read and explained to her, declaired [sic] that she had freely valenteraly [sic] and with constrained [sic] signed and acknowledged the same and wisht [sic] not now to retract it.
