Stout Be it remembered that I Hezekiah Stout of the County of Gilmer and State of Virginia, and late of the County of Lewis and State aforesaid, Did for and in consideration of the Love and affection and esteem that I have for my son John W. Stout then of the said county of Lewis, but now of the county of Braxton & State aforesaid bequeath unto the said John W. Stout a tract or parcel of land containing sixty four acres being a portion of the lands then owned and occupied in the then County of Lewis, but now lying in the County of Gilmer by a deed of Conveyance, which deed was dated on the third day of September 1833 and was acknowledged by me and my first wife Nancy Stout before two Gentlemen Justices of the County of Lewis, on the 7th day of the same Month and year, & said deed was admitted to record in the 13th day of the same, month and year in the Clerks office of the County Court of said Lewis County in Deed book E. Page 265 and whereast he said deed of conveyance contained certain conditions which were as follows to wit, Enjoining the said John W. Stout to reside on the said land and prohibiting the said John W. Stout, from permitting any other person or person to encumber or cultivate the said land during the natural life of me the said Hezekiah Stout against the good will and pleasure of me the said Hezekiah Stout and whereas it seems to suit the present convenience and interest of the said John W. Stout not to reside in the said land and furthermore, that it suits his present convenience to sell and dispose away the said tract of Land, now, I the said Hezekiah Stout for the continued Love affection and esteem that I have for my said Son John W. Stout and for the further consideration that the said John W. Stout shall reconvey unto me a certain portion of the said land continuing seven acres, which the said John W. Stout hath done by a Deed of conveyance dated ont he twentieth day of March 1847. Do by these presents annul, release, and acquit all the conditions that I have imposed on the said John W. Stout in the deed aforesaid, hereby vesting in the said John W. Stout a complete title in fee simple to the said land, Authorizing him to do with or dispose of the said land as he may deem right fit or advantageous, and I do hereby declare that it is my good will and pleasure that the said John W. Stout, Shall and may as do as he may deem proper in regard to the said land, and that any disposition that he may have previously made in relation to the land, I hereby fully approve of ratify and confirm, In testimony whereof I have hereunto set my hand and affixed my seal this fifth day of April 1847.
