Mann and Alice his wife and Anthony Bowen and Mary his wife of the one part and John Joseph Maze of the other part. Witnesseth that the said Moses H. Mann and Alice his wife and Anthony Bowen and Mary his wife for and in consideration of the sum of $1 to them in hand paid by the said John Joseph Maze have bargained sold aliened, conveyed, enfroffed, and confirmed and by these presents do bargain, sell, alien, convey, enferff and confirm to the said John Joseph Maze for his own use and benefit a certain piece or parcel of land situated lying and being in the county of Greenbrier in the east side of Greenbrier River and within the bounds of a tract of land of 590 acres granted to Andrew Hamilton, dec. which has been claimed by the heirs of James Maze, dec and has long been the subject of a lawsuit between them and the heirs of the said Andrew Hamilton, dec. to which the said Moses H. Mann and Anthony Bowen are parties and which said suit is yet undisposed of finally in the circuit superior court of said County of Greenbrier and the part of the said tract of 590 acres which is hereby sold and conveyed to the said John Joseph Maze is that part thereof (be it little or much and lie where it may) which belongs to the heirs of the said Andrew Hamilton, dec. under the decree that was rendered in the aforesaid suit by the superior court of chancery holden at Lewisburg and which decree was afterwards affirmed by the court of appeals it being that part of said 590 acre grant which is not repealed by the aforesaid decree in favor of the pre-emption claims of 500 acres of the said James Maze,dec. to have and to hold the said piece a parcel of land with all and singular the hereditaments (sp?) and appurtenances to the only proper use and behooves (sp?) of the said John Joseph Maze and his heirs or assigns forever and the said Moses H. Mann and Anthony Bowen for and on behalf of themselves and their heirs, do hereby jointly and severally, covenant and agree with the said John Joseph maze that they will warrant and forever defend the right and titles of in and to the aforesaid piece or parcel of land unto the said John Joseph Maze and his heirs or assigns against the lawful claim of all persons that then and in that case they the said Moses H. Mann and Anthony Bowen, will pay to the said John Joseph Maze the value of said piece or parcel of land as it may be at the time it shall be recovered from the said John Joseph Maze or those claiming under his. In witness, whereof the said Moses H. Mann and Alice his wife and Anthony Bowen and Mary, his wife have hereunto set their hands and seals the day and year above written. Note, before signing this deed it may be proper to state that the quantity of land, hereby sold is probably about 130 acres more or less and it may lie in more pieces or parcels than one. Moses H.
