FIRST: I direct that all of my just debts and funeral expenses be paid by my Executrix, hereinafter appointed. SECOND: I give, devise and bequeath to my beloved wife, Lillian Viola Loudermilk, all my property, of every kind and class, real, personal or mixed, wherever situate, absolutely and in fee simple. THIRD: I hereby constitute and appoint my said wife, Lillian Viola Loudermilk, as Executrix of this my last will and testament, with the request that she permitted to serve without surety on her bond. IN WITNESS WHEREOF, I have hereunto signed my name and set my seal to this my last will and testament, this 8th day of September, 1949. A paper purporting to be the last will and testament of Clarence Elmer Loudermilk was this day produced before PAUL C. HOGSETT, Clerk of Greenbrier County Court, in his office, and it appearing that Clarence Elmer Loudermilk, the Testator was a resident of the County of Greenbrier and State of West Virginia, at the time of his death, that the said annexed will was duly executed by the said decedent in his life time, and signed by the said Clarence Elmer Loudermilk in the presence of Samuel Price and Marion Clendenen; Marion Clendenen the surviving subscribing witness thereto, who after having been first duly sworn did despose and say that the Testator acknowledged the execution of the same in their presence, and declared the same to be his last will and testament, and the said Marion Clendenen and Samuel Price signed the said paper writing as witnesses, at his request, in his presence and in the presence of each other, that the said Clarence Elmer Loudermilk at the time of executing said will was of lawful age, and was of sound and disposing mind and memory, and said paper writing is ordered to be recorded as the last will and testament of Clarence Elmer Loudermilk, deceased.
