Witnesseth that the part of the first part do hereby bargin and sell unto the party of the second part that farm of land and premises in said county on which they now reside, adjoining Geo Allison and others containing one hundred and ninety acres be it same more or less, for and in consideration of that the said Samuel McHenry binds himself to pay to his brother and sisters the following sums, viz four hundred dollars within two years after the death of his father and mother to be paid to David mcHenry, one hundred dollars to Elizabeth Baily in three years. One hundred dollars to Nancy Mathison (Mathewson) in four years. One hundred Dolars to Jane Summerwell in five years and to Mary Anne Andrews one hundred dollars in six years from the death of his father and mother, further to keep his brother James, who is not of sound mind. After the death of his parents, during the natural lifetime of said James unless he should come so uncontrollable that he the said James could not with safety to himself and family manage him, in which case he is be released and free from keeping him longer--He the said Samuel is to deliver in the milk? to/or usual? market or on the premises as required the one third of the produce raised on the premises during the lifetime of his father and mother to them or either of them. The party of the first part futher ^specially reserves during his and his wife's lifetime, the dwelling house and his personal effects with twenty acres of pasture if _____ the keeping in winter of his cows and more than fifty sheep and one hog. The said Samuel to furnish to the said James and his mother all necessary milking? and all other attention to them or either of them and to his brother James, during the natural lifetime of his father and mother also attention and food? to the stock above mentioned when necessary. He the said Samuel has and is released to him any right I may have to any farming utensils of mine on the premises or of any which I might claim. These claims, considerations, privileges, to be a lien on the land until all are discharged by the said Samuel McHenry to the said James McHenry and others concerned. Witness our hands and seals this 10th day of August 1854----attest Thos. Bambich Jas McHenry {seal} Samuel McHenry {seal} State of Virginia, Hancock County: I Thomas Bambich a Notary Public within and for said County do certify that James McHenry of the first part and Samuel McHenry of the second part to the foregoing instrument of writing personally appeared before me in my said County on this 10th day of August 1854 and acknowledged the same to be their act and deed. David McHenry (Elizabeth) is found living in Illinois and Kansas Elizabeth Bailey(Evan) is found living in Fulton Co., Illinois Nancy Mathewson (John) is found living in McDonough & Fulton Co. Illinois Jane Summerwell(William, also seen as Somerville) is found in Pa & Missouri. Daughter Rebecca baptised 23 Sep 1821 by Rev. Geo Scott is not listed and has passed by this date (1854). She is possibly wife of Willian Kevan. Not Margaret listed in his Beaver Co., Jordan Biography. His wife died 1849. James Stewart McHenry - baptised 06 Sept 1818 by Rev. Scott - no further known. Samuel McHenry - (Mary C. Scott) dies in 1885, buried in E. Liverpool.,Ohio Mary Ann Andrews (Jeremiah) is found living in Columbiana Co. and dies there.
