All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/wv/wvfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Denise Seevers craigseevers@sbcglobal.net August 10, 2009, 7:23 am Source: Washington County Pa Will Book 4 Pages 364-366 Written: May 13, 1828 Recorded: August 14, 1828 Will of Jeremiah ] The last will and Testament of Jeremiah Andrews Andrews Deceased ] of Smith Township, Washington County, Witnesseth that I dispose of my estate real and personal in the following manner vis: Item first, I give and bequeath unto my wife Susannah my black mare, her saddle and bridle, one cow her choice of my cattle, a bed and bedding, a table, a chest, three chairs and one half of my dresser furniture, all in perpetuity and forty dollars annually and a room in the house where I live during her lifetime, but if she chooses to live elsewhere she shall be paid forty dollars annually to be a lien on the plantation where I now live. Second, I give and devise to my son Mathew Andrews the use of [one] hundred and ten acres of land in Brooke County, Virginia during his lifetime and I give and devise the said one hundred and ten acres of land to lawfull heirs of my said son Mathew after his death to be divided amoung said children, share and share alike. And I hereby direct my Executors to sell and convey eighty acres of land not before disposed of it being the West end of the tract last mentioned. But if my said son Mathew will pay my Executors two hundred dollars with lawfull interest from this date, then this eighty acres shall be my son Mathew's forever. Third my son Jeremiah Andrews has received a conveyance from me for land in Brooke County Virginia which is to be considered in full of his divide of my estate. Fourth I give and devise to my son Joseph Andrews the plantation on which he now lives, upon condition that he pay three hundred and six dollars with the interest due on it which I am indebted to John Hunter, and two hundred in one year after my deceas[e]. And these sums shall be a lien on the last mentioned piece of land until discharged. Fifth I give and devise to my son John Andrews the plantation whereon I now live together with my stock of cattle (except the milch cows) my farming utensils and one sorrel more, upon condition that he pay his mother forty dollars annually, and furnish her with a room to live so long as she chooses to live with him and pay seven hundred and fifty dollars or as much as is hereafter provide for with interest due thereon which I am indebted to Nathan Scott. And also five hundred dollars to be paid in three years after my decrease and appropriated as hereafter directed. Seventh I give and devise to my daughter Nancy Carlile one hundred dollars in addition to what she has received from me to be paid in seven years from this date and it is my will that my obligation I hold against Andrew Carlile be given at without payment at my deceas[e] Seventh I give and bequeath to my Daughter Elizabeth Scott three hundred dollars to be paid in five years from this date. Eighth I give and bequeath to my daughter Katharine Scott three hundred dollars to be paid in seven years from this date. Nineth I will and bequeath to my grandson Jeremiah Andrews son of Jeremiah one hundred dollars to be paid when he arrives at the age of twenty one. Tenth if any of my heirs should present demands of any kind against my estate it is my will that amount of such demands be deducted out of their legacy so that the above legacies shall be in full of all demands, and all obligations I hold against any of my heirs shall be given up without payment. Eleventh If any of my sons shall refuse to receive the bequesths upon the conditions therein mentioned then, my executors are hereby authorized to sell and convey such part as may be refused. Twelveth All the remainder of my property not disposed of I direct to be sold at the discretion of my Executors and all my effects not disposed of after the payment of my just debts (not before mentioned) And funeral expenses I direct to be appropriated to the payment of the debt due Nathan Scott. And if it is not all necessary the overplus shall be divided equally among my surviving children. Lastly hereby appoint James Brown, Joseph Andrews and James McFarren Executors of this my last Will and Testament. In witness thereof, I have hereunto set my hand and seal this 13th day of May 1828. Cunningham Deputy Register for the Probate of Wills and granting letters of Administration in and for said County came William Tenan and Benjamin Boice two of the subscribing witnesses to the withn last Will and Testament of Jeremiah Andrews deceased who being duly sworn, Sayeth that they were present and did see the Testator thereof sign this Will and did hear him publish, pronounce and declare the Same as and for his last Will and Testament. That at the time of his so doing he was of sound and deposing mind, memory and understanding to the best of their knowledge, observation and belief. And sworn to and subscribed before me Saml. Cunningham Dp Regr William Tenan Benjamin Boice August 14 1828 Letters Testamentary with copy of the Will and probate annexed issued to James Brown Joseph Andrews and James McFarren the Excecutors within named, who on same day were duly sworn. Jeremiah did skip the Sixth bequest and have two Sevenths listed in his will.
